When we last entered the US, our immigration officer said "Oh, hmm I wonder if I could go ahead and change you an IR-1." The agent right next to him said "Yes, you can do that" and he acted surprised. His comments made it pretty clear he was going to erroneously issue us a CR-1 and he seemed to not even know he could change the visa status until his coworker advised him (THANK GOODNESS she overheard!). I don't know how onerous the process is to correct such an oversight but I'm glad we didn't have to find out!
Just wanted to pass this along in the hopes it saves someone from any problems with the wrong stamp being placed in the passport, as I've read about here before.... I would kindly remind the officer "We married >2 years ago. We can enter with an IR-1 visa now right?"- 19 replies

I entered the U.S. on a K-1 visa on June 1st and left for Canada on June 2nd, remaining here for 20 days. I am now attempting to return to the U.S. through Toronto Pearson Airport (YYZ) using Automatic Visa Revalidation (AVR). My K-1 visa is expired, but my I-94 is still valid. Am I ok?-

Wrong USCIS application form filed by my lawyer!

Hello, so my wife came in k-1 visa to USA and we got married and all. We filled for work permit and green card together but while doing that my lawyer filed for I-130 no idea why. Will that application make my process for work permit and green card slow? If so how do I withdrawal that application? My lawyer isn’t helpful at all. I need some help…-

Seeking advice for Thai/US couple - What US visa path to take?

My gf and I live in Thailand but spend 2-4months in the US per year. Once/if we have children age 5+, the time split would become vice versa. We have no plans to live full-time in the United States in the next 5 years, but I visit my family and friends 2-3x per year for 2-3 weeks at a time. I would love it if she can join me for those trips and experience that part of my life. What options do we have -- US visa wise, maybe a tourist or fiance visa later? Other?

Abandoned AOS and now regret it

Please be nice, I know I made a mistake... But got my K1 approved and arrived in the US June 25, 2024 and applied for AOS February 25, 2025 -- then left the US (abandoned my AOS). Will I be banned for re-entry to the US -- even under a spouse visa?-

I'm currently living and working in the United States. My fiancé currently lives in Japan. We have been dating for about 6 months, and we have met in person several times, but we are not yet married.
My fiancé will be visiting me in the United States on a tourist visa some time in March or April and staying for about 3 months. I want to file for a fiance/spouse visa asap -- what's next?-

2 RepliesI tried to pay immigrant fee under the instruction on the immgration package, but I cannot not proceed as it show "could not find the A- number". I have tried the AI support and call 800 number. It cannot solve my problem with lopping dead ends. So frustrated. Anyone can advice where (website) should I seek for help, as the immgration package suggest: "You must pay before you travel to the United States. You will not receive your Green Card until you have paid the USCIS Immigrant fee." Thanks in advance.

I was instructed by the NVC that the documents for Immigrant's Visa Application for my 2 sons need to be mailed to DOS Visa in VA. I sent the 2 separate packets to DOS VISA through USPS Registered Mail on Monday September 8. I checked on the USPS tracking that the packets have been delivered and are available at a PO Box on September 11, 2025 in STERLING, VA 20166. How would I know that the packets are already in the hands of the NVC staff?

9 RepliesHello everyone I'm new here. My fiance and I need some help. We're currently deciding whether we should marry in Haiti or in the U.S being that he currently holds a tourist visa and travels back and forth. I heard about a 90 day rule and also he has no intentions to overstay his visa.
Also once married we plan to adjust status from the visitor visa, do we than do an i130 or an adjustment of status application. My step children will be included in the application however they are in the US on another status (political asylum)

14 RepliesI'm a naturalized US citizen. My dad just passed away in a Chinese hospital. My mom's sister also passed away a couple years ago in another hospital there. My mom is living with my sibling in Shanghai.
My mom, in her 80s, is in very week health condition. She takes very strong/disuptive pill against mental health for decades, and pills against heart problem for at least years. But those doesn't solve the problem so she has to ask me to search online how to solve problem of constantly feeling dizzy due to heart problem.
I want to get my mom to U.S. to get medical treatment and live here for the rest of life.
But what's the fastest way to get her to U.S. AND get green card?
Safest is I-130. But that takes a couple years. I'm not sure if my mom can survive to that date. Also that needs her to travel from Shanghai to Guangzhou to do interview, that trip alone is extremely difficult to her and to my sibling.
Or we can get her by B-2, and then apply to adjust status. But, that obviously cheated in B-2, also if that later adjustment is refused due to this reason or else, I'm sure she can not survive that blow.
I heard there is some channel to expedite I-130 for humanitarian reasons, but also there is no proven procedures and approval is rare.

I will need my passport back before early October for travel and was wondering how long it usually takes the consulate to return it once a request is made. Ideally, I would prefer that they hold on to it for a while in case they are able to issue my visa before I ask for it back.
Additionally, does anyone know if there is a faster way to get in touch with the consulate, such as by phone?
Any advice or suggestions would be greatly appreciated. Thank you in advance!
