PSA: If entering the USA 2 years after marriage, kindly remind the immigration officer of this

When we last entered the US, our immigration officer said "Oh, hmm I wonder if I could go ahead and change you an IR-1." The agent right next to him said "Yes, you can do that" and he acted surprised. His comments made it pretty clear he was going to erroneously issue us a CR-1 and he seemed to not even know he could change the visa status until his coworker advised him (THANK GOODNESS she overheard!). I don't know how onerous the process is to correct such an oversight but I'm glad we didn't have to find out!
Just wanted to pass this along in the hopes it saves someone from any problems with the wrong stamp being placed in the passport, as I've read about here before.... I would kindly remind the officer "We married >2 years ago. We can enter with an IR-1 visa now right?"- 20 replies

I entered the U.S. on a K-1 visa on June 1st and left for Canada on June 2nd, remaining here for 20 days. I am now attempting to return to the U.S. through Toronto Pearson Airport (YYZ) using Automatic Visa Revalidation (AVR). My K-1 visa is expired, but my I-94 is still valid. Am I ok?-

Wrong USCIS application form filed by my lawyer!

Hello, so my wife came in k-1 visa to USA and we got married and all. We filled for work permit and green card together but while doing that my lawyer filed for I-130 no idea why. Will that application make my process for work permit and green card slow? If so how do I withdrawal that application? My lawyer isn’t helpful at all. I need some help…-

Seeking advice for Thai/US couple - What US visa path to take?

My gf and I live in Thailand but spend 2-4months in the US per year. Once/if we have children age 5+, the time split would become vice versa. We have no plans to live full-time in the United States in the next 5 years, but I visit my family and friends 2-3x per year for 2-3 weeks at a time. I would love it if she can join me for those trips and experience that part of my life. What options do we have -- US visa wise, maybe a tourist or fiance visa later? Other?

Abandoned AOS and now regret it

Please be nice, I know I made a mistake... But got my K1 approved and arrived in the US June 25, 2024 and applied for AOS February 25, 2025 -- then left the US (abandoned my AOS). Will I be banned for re-entry to the US -- even under a spouse visa?-

US Citizen with Foreign Fiancé: When and How to Get Married?

I'm currently living and working in the United States. My fiancé currently lives in Japan. We have been dating for about 6 months, and we have met in person several times, but we are not yet married.
My fiancé will be visiting me in the United States on a tourist visa some time in March or April and staying for about 3 months. I want to file for a fiance/spouse visa asap -- what's next?-

I am a U.S. citizen, and my wife received her conditional green card (CR-1 category) in 2023. As the expiration date approaches at the end of this year (2025), we filed the I-751 petition to remove conditions on residence through the USCIS online system.
However, the issue is that I mistakenly submitted her I-751 under my USCIS online account (the U.S. citizen spouse account), not my wife s account. Because of this, we still have not received the Receipt Notice (Form I-797) even after more than a month. Without the official receipt and automatic extension, my wife is now facing difficulties such as renewing her driver s license and other identification issues.
We contacted USCIS by phone and through the online chat, and we were advised to upload an affidavit or letter requesting USCIS to transfer the I-751 case from my account to my wife s USCIS account. We uploaded the affidavit as instructed, but we have not received any response yet.
After 30 days from the initial submission, we also submitted a Did not receive Receipt Notice inquiry, and that inquiry is now with the National Benefits Center. We were told it may take up to another month to receive a response. (For reference, all documents were filed online. My account shows a receipt number (IOE ), and the status says Case was received and a receipt notice was sent, even though we have not received the notice.)
During a recent Emma chat session, the representative suggested withdrawing the I-751 filed under my account and resubmitting it through my wife s account. However, since withdrawal cannot be done instantly online and must be submitted as a written request, we are concerned that re-filing could cause complications or duplicate filings.
Given this situation, I would like to ask:

Is it safer to wait for USCIS to act on the affidavit/letter we uploaded requesting the case transfer?

If not, what is the proper way to contact USCIS to ensure the affidavit is reviewed?

Would withdrawing and re-filing in my wife s account cause any issues?

Hi all,
I am a GC Holder since Dec 2021. I had booked a trip to visit my country of origin (Nigeria) in Feb 2026.

I had wanted to travel to see my wife as we are processing here I-130 to collect more evidences of a relationship for the NVC stage (pictures, receipts etc). My PD date is May 2025. I also just wanted to see her.
Since Nigeria is one of the banned countries from the Dec 17, 2025 proclamation (https://www.whitehouse.gov/presidential-actions/2025/12/restricting-and-limiting-the-entry-of-foreign-nationals-to-protect-the-security-of-the-united-states/, https://www.whitehouse.gov/fact-sheets/2025/12/fact-sheet-president-donald-j-trump-further-restricts-and-limits-the-entry-of-foreign-nationals-to-protect-the-security-of-the-united-states/), I have two questions:
(a) Would it be wise to still travel in Feb 2026 or move it to Dec 2026 or to just wait until I get my citizenship in 2027
(b) If i wait until i get my citizenship in 2027 (Processing time for Norfolk VA is 8.5 months according to https://egov.uscis.gov/processing-times/), what can I do in the time to gather more materials to appropriately tackle any (knock on wood0 RFEs?

3 RepliesI am currently outside the country traveling on advance parole (Form I-131). Recently, my country was added to a partial travel ban list, and the ban is scheduled to take effect on January 1. Will I be in trouble if I come back to USA mid February?

1 RepliesI ve submitted Form I-131 for a Re-entry Permit and observed that the current edition of the form does not request a reason for applying. Older versions of the form did include a purpose of trip section; however, this section has been removed for Re-entry Permit filings and now applies only to Advance Parole applications.
Based on the latest USCIS form and instructions, the application appears complete, compliant, and aligned with current requirements, with no obligation to state a reason.
Sharing for confirmation and reassurance.
