When we last entered the US, our immigration officer said "Oh, hmm I wonder if I could go ahead and change you an IR-1." The agent right next to him said "Yes, you can do that" and he acted surprised. His comments made it pretty clear he was going to erroneously issue us a CR-1 and he seemed to not even know he could change the visa status until his coworker advised him (THANK GOODNESS she overheard!). I don't know how onerous the process is to correct such an oversight but I'm glad we didn't have to find out!
Just wanted to pass this along in the hopes it saves someone from any problems with the wrong stamp being placed in the passport, as I've read about here before.... I would kindly remind the officer "We married >2 years ago. We can enter with an IR-1 visa now right?"- 19 replies

I entered the U.S. on a K-1 visa on June 1st and left for Canada on June 2nd, remaining here for 20 days. I am now attempting to return to the U.S. through Toronto Pearson Airport (YYZ) using Automatic Visa Revalidation (AVR). My K-1 visa is expired, but my I-94 is still valid. Am I ok?-

Wrong USCIS application form filed by my lawyer!

Hello, so my wife came in k-1 visa to USA and we got married and all. We filled for work permit and green card together but while doing that my lawyer filed for I-130 no idea why. Will that application make my process for work permit and green card slow? If so how do I withdrawal that application? My lawyer isn’t helpful at all. I need some help…-

My gf and I live in Thailand but spend 2-4months in the US per year. Once/if we have children age 5+, the time split would become vice versa. We have no plans to live full-time in the United States in the next 5 years, but I visit my family and friends 2-3x per year for 2-3 weeks at a time. I would love it if she can join me for those trips and experience that part of my life. What options do we have -- US visa wise, maybe a tourist or fiance visa later? Other?

Please be nice, I know I made a mistake... But got my K1 approved and arrived in the US June 25, 2024 and applied for AOS February 25, 2025 -- then left the US (abandoned my AOS). Will I be banned for re-entry to the US -- even under a spouse visa?-

I'm currently living and working in the United States. My fiancé currently lives in Japan. We have been dating for about 6 months, and we have met in person several times, but we are not yet married.
My fiancé will be visiting me in the United States on a tourist visa some time in March or April and staying for about 3 months. I want to file for a fiance/spouse visa asap -- what's next?-

2 RepliesHas anyone recently imported your vehicle at the border after CR1/IR1 approval?
I am a U.S. citizen but lived in Canada for 11 years and moved back to U.S. recently. A few weeks ago I went to a port of entry in the states to import my Canadian car. They stated I had to use an importer now and will need to pay an extra 25% tariff. So I guess I ll drive my car back to Canada and sell it.
I m curious though when my Canadian husband gets his green card approval soon will he need to pay the tariff on his vehicle also? Or will it be duty/tariff free doing it at time of your first border crossing?

Because I (the original sponsor & petitioner) already submitted an i864 pre-DQ, is my joint sponsor limited to filling out another i864 form? Or can the joint sponsor, my mother, who is under the same household as I am, fill out the i864a?

If my mother fill out the i864a, does that mean I need to adjust some information under my original i864 (ie. add my mother's name into the original form)? Or is that unnecessary at this point, post DQ?

Because mom barely understands English, I'm able to fill out most of the form on her behalf, right? She just needs to sign it and provide evidence of her financial situation?

1 RepliesHi all, quick question on the Part 14 of 485 and similar Additional Information sections on the 864 and 765. For the 485, we used a separately typed and printed 7 sheets for address and work history. Each sheet had the name and A-Number at the top. However, in the proper Form I-485 Part 14, we only put the A-Number at the top and didn't include any written information, including Family Name/Given Name in question 1.
Similarly, in the 864 and 765, we didn't fill in the name fields either due to not requiring any additional information sheets. The forms were mailed out today in this condition.Could this be used a a strike against the application?

The USCIS has introduced new rules for marriage-based green card applications, effective from August 1, 2025. These changes apply to both pending and new petitions, as outlined in the 'Family-Based Immigrants' section of the USCIS Policy Manual.
This includes mandatory in-person interviews for couples applying for a green card through marriage.
Anyone know more about these changes? Sounds pretty nuts. Then again, I have found the accuracy of MSN news items that pop up on my screen to be very far from accurate...
I suspect there is some exaggeration here... they aren't really requiring all immigrant couples to attend a government interview are they?

Additionally, USCIS has broadened its ability to conduct unannounced home visits, especially for marriages under two years, to verify the relationship's legitimacy and combat fraud.
I know marriage fraud goes on all the time. And perhaps this can catch some of it. But it's gotta be unnerving for the vast majority of us doing things above board. Unannounced home visits by federal agents as a routine policy is not something I had on my bingo card for 2025.
I would expect we will have more fee increases soon to pay for all these extra bureaucratic processes.
Sure glad we have our green card and have passed the 2 year mark!
