My fiance & I are still waiting for his interview to be scheduled, but are trying to plan ahead :) If he is lucky enough to get an EAD stamp is it valid for 90 days or just until we are married? So, if he got stamped & we were married & filed for AOS shortly after his arrival, would he be able to legally work for the 90 days after his arrival?

For some reason I was under the impression the EAD would not be valid once we were married.

Thanks for any insight...this stuff is confusing :) Good Luck with your journeys!!!

Your impression is wrong. EAD stamp is based on expiration of the I-94 card (90 days after entry), NOT on when you get married.

So if the SO is going to enter through JFK.... How does he ask for the stamp? When he first goes up to the window? Does he say "Could I please get a work stamp?" Any tips? My SO doesn't speak English very well and I want to help him out and tell him what to say... He's also going through on Christmas Eve, so I'm thinking it's going to be crazy and the officers might not have much patience....

Yan went through JFK last april and she never asked for one. They just stamped EAD and gave back her passport . I have flown christmas eve before and hardly anyone was at the airport. I believe the day before would be more crowded. This flight was not international that I was on.

They will put a stamp on the back of the I-94 card in passort. That will say Employment authourization and a date that it expires. Which will have the same expiration as the I-94, (90 days), it doesn't expire because of marriage. Also, for my husbands experience he did not ask them to stamp it with EAD, the just did it. Best wishes.

I'd like to add, if your SO flies through JFK to get EAD and starts working(like my husband did), try real hard to do AOS soon, because he will have to stop working if you don't, which is what my husband had to do and now he is bored as hell sitting at home. Wishing we would have filed AOS right after he arrived. Though, his job is holding his position, but USCIS is very slow sometimes, with us they are anyway.

This was sent to me before Yan came to JFK by a visa journey member. .........

It took almost 3 hours to go through immigration, allow the extra time. It all depends upon the motivation of the people working, some are real lazy. If she wants to work she will need to request that her I-94 is stamped with "Temporary Woek Authorization". JFK is the only POE still doing this. After she gets out of immigration there are cart racks, it costs $3.00 in quarters. They are sometimes, if not sold out, available at the baggage claim before immigration. After she comes out into the open area she will have to board the airtrain which goes between terminals. It is a hike to get to the station. My Fiancee came in on American Airlines, Terminal 8. Other termonals/airlines may be better. They are remodling JFK and Terminal 8 is still old. We had to walk to Terminal 9 to board the airtrain. My honest opinion is that you should go to New York to meet her. Get a room close to the airport, such as the Fairfield Inn, and take their shuttle to the airport. Meet her, let her grt some sleep before continuing your journey. My Fiancee came from Ukraine and had been up for almost 24 hours when she finally cleared immigration. We were driving home from the airport to Buffalo. It made her first night much more relaxed and our drive was really nice as she was awake and checking out her new country. Just my opinion, it may not work for you. But I would really stress that she can use your help at the airport after clearing immigration. My Fiancee also speaks english, it is more just getting through a strange airport when you are real tired. Good luck and let me know how it goes...

Thanks for the help :)

I'll tell him to ask for it if they don't stamp it, but make sure and watch to see if they do.

He's the type that would get bored quickly without work, so we were planning on filing asap for AOS, EAD, and AP. We are actually going to file the marriage certificate on the 24th (the office is open, but closes early) so we can send in the applications quickly (that and religous reasons ;) ) I only hope that it doesn't take too long to get the EAD after the stamp expires. :blush:

Guys,

maybe a really dumb question, but what the heck:

I've read that JFK sometimes even gives out EADs which are valid six or even 12 month, is that true? Does anybody know more about this, or is it just false info?

Hmmm.... I have never heard of this happening.

When my husband entered the US he got a 3 month EAD stamp at JFK... on a K1 visa.

6/19 Interview- APPROVED K1 visa

8/3 Fede arrives in JFK, gets work authorization stamp

I got an EAD stamp at JFK and it has no expiration date anywhere on it. I asked the POE officer if EAD would expire together with the I-94 and if I would have to cease to work until my permanent EAD or Green Card. He said NO, upon my marriage my K-1 acts as my GC and I don't have to stop working.

I guess he must be mistaken? No?

You were given incorrect information..... the temp EAD expires 90 days after entry, it does not expire when you marry and it is never acts as a greencard.... your Employment Authorization ends when the temp EAD expires and you are not Authorized to work again until you receive the 1 year EAD that you will file for along with your AOS....

JFK isn't the only one that does it though. I got mine at a border crossing in Detroit. I didn't even have to ask for it. The officer said that it is policy to stamp the I-94..

JFK isn't the only one that does it though. I got mine at a border crossing in Detroit. I didn't even have to ask for it. The officer said that it is policy to stamp the I-94..

So if it's the policy, why the stupid rule that temp. EAD expires in 90 days and you have to stop working until your 1-year EAD? I doubt many people get their 1-year EADs in less than 90 days from entry, and stopping-work-then-starting again doubles the amount of paperwork for SSA and the employers. What's the point of this POE policy if there's such a little chance of continuity? And what's the point following the rule if it's so f###ing dumb?
