can someone please tell me why can a I129f petition be denied in USCIS and how people know about it? Has anyone heard or experienced anyhitng of the sort? i will be very greatful for any info please! :help:

I-129F Sent .......... 2007-05-29 toNSC, then forwarded to CSC

I-129F NOA1 ........ 2007-06-15

I-129F RFE(s) ........ 2007-10-18 (very bad day, yak)

RFE Reply(s) ......... 2007-11-06

Denied 2007-12-14 because of missing divorce paper. Lawyer swears she sent it and we will file motion to reopen file ...how long?

Interview at Embassy in Bucharest 2008-03-14 - Approved!!!!!!!!

Entry in the USA 2008-05-01

Married 2008-06-21 (hubby almost broke his ankle and a black bird hit our windshield while driving to the courthouse hahah!

There are plenty of denials, and plenty of reasons for denials. The denial can come at any stage - at the petition stage, where USCIS sends a notice of intent to deny to the petitioner, or at the interview where the beneficiary is told in the face to face meeting. Some common reasons include: overstays, not meeting in person within the last two years, Crimes of Moral Turpitude including drug and alcohol related offences, suspected fraudulent relationships, or missing documentation.

People who suspect that they may have a deniable case often go to the interview with the relevant waiver prepared, to shorten the process a bit.

wow, this is helpful, at least i know where i stand...none of the reasons above are for us though, this is madness, but hopefully we will be able to appeal..this is what we had online Current Status: We mailed you a decision... so i guess we all know what that means... thank you for info,

Laura, I wouldn't fret. It could just be something silly your lawyer filled out incorrectly, and just means re-filing! Almost any reason for denial can be appealed, and there are people here who have done just that to share their experiences with you. You'll get past this, it's only one setback and compared to the rest of your lives together, a relatively short amount of time to spend on it, too.

Read this thread to read about another VJer who got the same notice that you did. His petition was denied.

You will need to wait for the letter to find out the reason for denial and start either an appeal, or file a new petition with an IMBRA waiver.

you know everybody who follow the visajourney guid has not fail if they get everything to gether, but if you are missing evedence, and your evedence are not making any scens they will deny your petition. so don't worry if your petition is not deny, just follow the guid and you will be fine.

December 28-----NVC send to US embassy in Ethiopia

January 8---------US embassy in Ethiopia will recieve

February 7 -------Interview

February 7 -------Passed interview

February 12------VISA in hand

February 22------IN the USA

March 1-----------Wedding

March 15----------Sent AOS

July 7 -------------Finger Print

January 27, 2009--Green card approved without interview. It took almost one year though.

Feb 2 -------------Got the green card in the mail

Next: playing the waiting game for the 2 years holding removal

That is not necessarily true. I know of people who have followed the guides to a "t" and still got denied for some crazy reasons.

That being said, as a general rule, that is usually true what you said.

Other common reasons would relate a lack of evidence, one of the parties is free to marry or the petitioner is not a USC.

A K-1 is a visa. The USCIS does not issue visas. Therefore no K-1's are denied at the service center...

Right, it's the I-129F petitions intended to result in K1 visas that are denied at USCIS service centers.

we are both freee tomarry, met more than 6 times and lived together 3 months, lots n lots of evidence, lawyer, no fraud, no criminal records, maybe some stupid signature that maybe our lawyer forgot ...this is stupid and heart breaking....thank you all for replying..

31st August 10 - NOA1 from VSC

10th January 11 - I-751 approved!

14th January 11 - 10-year green card in hand!!

22nd April 23 - N400 submitted online; NOA available in USCIS account immediately
6th November 23 - Interview; approval same day
28th November 23 - Oath ceremony scheduled
