Petitioning for Wife's 13 Year Old Son

Hi Folks,

 

I'm not sure if this belongs in this forum or the LPR forum...my wife came over to the US in May of 2023 on a K1 VISA. We married in June of 2023 & she received her green card in January of 2024. She has two sons...one (currently 6 years old) who came with her as a K2 & also got his  green card at the same time. The other son (currently 13 years old) decided to remain behind with his father & his family. We just submitted their i-751 RoC form last month. Within the last week, her 13 year old son who is in the Philippines suddenly wants to come over to the US. What I am trying to find out here is what are our options at this point in time? Do I need to petition for him? Can she petition for him as an LPR? Will her current RoC status allow her to do so? Are the current time lines (USCIS shows roughly 60 months for i-130 processing) still up to date? 

 

I am hoping to gain some guidance & wisdom from those of you who have already walked this path or for those of you who are currently walking this path.

Yes.  File an I-130.   It will be IR-2 category.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

It will be faster if you file because immediate relative category has no statutory caps so it never has any backlogs. 

 

She can petition him in F2A, and yes conditional permanent residents can sponsor relatives, that one is backlogged about 2 years. 

 

In any case that's done on form I-130. 

 

The processing times on USCIS.gov are roughly accurate but difficult to navigate. The one that is accurate in this case is the SCOPS one. NBC time only shows time estimates for adoption based I-130s, and field offices only really deal with ones that are concurrently adjusting status where the main hold up is the I-485.
