Hello, my wife (the US petitioner) has been living with me for 3 years now and not once travelled to the states, now we have included the following documents to show her intent to re-establish domicile:

 

1- A notarized letter from her father inviting us to live with him until we secure a rental and him stating that he will help us in this regard.

 

2-A signed and dated letter from my wife stating that she intends to reestablish her domicile and go the the states with me as soon as the visa is issued and saying that she filed for her taxes when she was here ( as she worked back when she was in the US but filed when she came here) and her voting for the presidential elections as absentee.

 

Note: we have a joint sponsor. NVC didn't have any problems with that and we were dqed. 

 

we had an interview in an embassy abroad but after a month they said  we cant do it since nvc shouldn't have transferred the case to us now go back to Cairo embassy for final review. however domicile wasn't brought up as an issue in that embassy at all. currently our case shows Transfer in progress.

 

how likely would we have to do another interview? 

 

will the Embassy (Cairo) give us a hard time since I heard many ppl complain about domicile issues? what can we improve that's doable in a short time?

I don't understand.....you had your visa interview, and the consulate sent your case back to the US?  Why?

July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

July 23, 2025:  Filed N-400 online

They said that the NVC shouldn't have moved my case to their embassy and according to US visa laws they can't make a decision because I don't have residency in that country.

My case wasn't sent back to uscis but they asked me to transfer it to Cairo since this the embassy that should make th decision since I'm Egyptian.

That you interviewed in Thailand and are Egyptian is the problem, particularly if you are not a legal resident of Thailand.  Details matter here.  Yes, it is very likely you will have another interview in Cairo.  My suggestion is for your wife to travel to the USA when you travel to Cairo, so that deals with the domicile issue directly.  You might find other advantages to that as well.

We really don't want to be separated, however In the previous interview the concerns about the domicile were minimal we were just asked about our plans when we go, not sure if Cairo is more strict in this regard tho but so far that evidence we supplied for intent to reestablish domicile isn't enough?

On what basis were you in Thailand?

 

They do not mess around in Cairo, not as bad as Canada.

Given that we have a notorized Letter of invitation to live with her parents and them helping us to find a rental later, her voting record and taxes that won't be enough to show intent to reestablish domicile? 

 

Also me and my wife were traveling through out Southeast Asia for months and we asked NVC to transfer it since we will be in Southeast Asia for months and months and didn't have an immediate plan to go to Egypt anytime soon. 

 

So if this wasn't allowed NVC should have just said no can't do, but unfortunately now we are paying the price for that mistake.

It is on you to make sure you are eligible for what you are requesting - NVC has no way of knowing if you are legally residing in another country.  

 

I understand you do not want to be separated, so go with your priorities.  If getting the visa fast is your priority, have her relocate first.  If you do not mind longer wait, then show what you have now, and accept possible delays/later separation if she needs to relocate.  No magic trick.

Your convenience and what you want are not priorities in this process.  There is going to be a risk that you are not only separated, but you wait in Egypt while your wife returns to the USA.  I cannot say how much risk or for how long.  I can only say that it is YOUR risk.

 

If there is a delay after the interview, you will endure that delay without your Egyptian Passport.

Consulates can interview visitors not sure how many do, did they know you were not resident beforehand?

 

Seems she has the bare minimum for domicile. That will be the Consulate decision if it is enough.
