Birth date different on passport

Indian Citizen: Birth date on passport and birth certicate is off by 10 days. Passport is 6 years old.

 

Indian goverment site says:

if the applicant was a major when his/her first passport with incorrect date of birth
was issued, he/she can correct it, within five years of issue of the first passport. No
change of date of birth is allowed afterwards.

 

Getting married to US citizen this month and want to apply for VISA.

What should I do?

Because you're getting married and your petitioner will presumably file the I-130 petition, your thread is moved from the K-1 Process forum to the CR-1 Process forum.  Knowledgeable people will answer soon.

Is the date on birth on passport wrong? What took you so long to notice?

I'd apply for new passport today. Make sure they use correct date of birth as stated on birth certificate.

 

I don't buy the argument it cannot be changed. Why would that be? If info is wrong, new passport based on birth certificate should be issued. Discrepancies like this can lead to severe issues with US immigration. Just get it fixed in India - it will be cheaper and less stressful than fixing later.

 

P.S. what if you lost your passport? What date of birth would they use in new passport? I'm sure it would be correct one, as on birth certificate.

Yes

No excuse. Never needed it. In India, it is common to use tenth grade certicate for DOB.

 

I posted it in K1 forum as we are also considering fiancee route to save time. I should have mentioned in OP.

Well, you'll get a lot of accurate comments about how the CR-1 visa (via the I-130 petition) is far superior to the K-1 visa (via the I-129F petition) and how they take essentially the same amount of time.  There are zillions of threads here about that.

K-1 
  More expensive than CR-1
  Requires Adjustment of Status after marriage (expensive and requires a lot of paperwork)
  Spouse cannot leave the US until she/he receives approved Advance Parole (up to 9 months)
  Spouse cannot work until she/he receives EAD (up to 9 months)
  Some people have had problems with driver licenses, Social Security cards, leases, and bank accounts during this period

Waiting time is biggest concen. At this time K1 time is at 8 months Vs CR1 18 months.

Which center processes K1 and CR1 applications for NC resident? I do not know which center to select to see the current processing time.

Don't believe it as gospel.  The timing is actually much closer.

Furthermore, you'll save at least that much time (and money, and grief) by pursuing the I-130 path.

To my understanding, petitions are sent to the USCIS center that has the least overwhelming workload at the time.

To the original problem.  Get a new passport in with the correct date of birth.  If that means starting over with a new passport application, that's what you do.  To change the date of birth on a passport would usually require issuing a new one anyway.  This is a major issue.  Get it done.

Processing centers are unrelated to USC state of residence.  99% of K-1s are processed at CSC.

 

Indian and Pakistani K-1s seem to be denied more than people from other countries, due to past fraud.  You may want to research this.
