Even when your I-751 is outside at the end of November and you file a request, they cannot do anything with it until your file and the N-400 application make their way through the NBC and back to your field office. Filing the request will most likely return a "still within normal time range" because you have the pending N-400.

Just so you know.

I believe my husband's case is similar. It's outside the normal processing times for our field office in Utah. It's approaching the 10 months mark and normal processing times are 8.5 months for Utah.He also has a pending I751 case  filed a whole year prior.

Sorry if I’m missing something but I thought the whole point of filing a request was to compel some kind of action. Why wouldn’t filing for the I-751 when it gets outside of processing time compel someone to go and find the file and send it to the field office?

None of these requests force USCIS to take an action. Only WoM does

I’m just worried that the writ of mandamus is quite a drastic draconian action. I fear that USCIS will then negatively view my case if I file a lawsuit against them. I mean they really shouldn’t especially if all is good with your case. Have you heard of any positive results with the writ?

in the meantime I have written to my congressional office for them to reach out to uscis. See if that produces any results. My next step was the ombudsman office and then only to consider a writ, but welcome any thoughts.

There's one lawyer who has large presence on YouTube. He specializes in Writ of Mandamus. It is an effective tool. According to him, suing does not cause any negative outcome, because you're not asking for money, to fire somebody etc. All you're asking for is for USCIS to do their job and give decision. Actually, you never end up going to court etc. The moment USCIS get served, they typically resolve it within 60 days and lawyer withdraws the lawsuit.

 

I've never heard of USCIS retaliating against somebody who used their legal right to file a lawsuit.
