She got her medical exam done in Italy, and we entered the US together on July 5 of this year. We got married and now we are submitting the AOS but she has misplaced her I-693 packet somewhere between the Port of Entry and home. She gave the packet to the CBP agent and got it back, but since we left the airport... who knows. Do we just bite the bullet and get another medical exam done (potentially with all the vaccines since I don't think she has any of her medical records)? She told me they don't require the form submitted in the package but I've seen conflicting information. Could we just submit the I-485 and wait to see if they send an RFE, and maybe she finds it before then? Thanks.

I assume she had everything done in Italy

 

I thought they sent everything electronically now? I remember being given my X Ray but that tuned out to be a souvenir.

Why did she get her packet back? Are you absolutely sure that she did? Normal protocol is for the packet to be taken at POE and they forward it on to USCIS. 

 

If the packet is taken and sent to USCIS, the I693 isn't needed as it includes the DS3025, which she should have recieved a copy of. You just write a letter stating the medical was completed with 12 months and include a copy of the DS3025 for reference.

Yes, it was done in Napoli. I'm not sure about electronic but she did for sure get a sealed envelope that she gave to CBP. You would think in the year 2025 that it would be entirely digital or at least have access to copies at any of the civil surgeon locations if needed.

No idea. We thought it was standard procedure. The packet was sealed, she gave to the kind CBP woman. She opened it, looked at something, I *think* she took something out and stamped it, then gave the entire packet back. My wife is certain she put it into one of our bags after, but we were so tired and stressed about what might happen at the border that she doesn't remember. We just aren't sure now if we should submit the AOS as-is with what we have and wait for RFE later in case we find it or at least get a second exam done. Because the instructions state that having the medical exam within one year of submitting the AOS means she won't need a second medical exam, she thinks it means that we don't need to submit the I-693. I said otherwise. One would think it would all be on a server somewhere, but unlikely.

If it was put in one of four bags, then that narrows it down significantly, no? So shouldn't be hard to find? 

 

If the packet wasn't forwarded to USCIS, then you need the I693, and will need to pay for a whole new medical. There's only digital records of things once USCIS scans it in. If they don't have the docs to scan, how are they supposed to know it exists? 

 

If you file for AOS without the medical, then there'll be an RFE. I don't know if it would result in automatic rejection. Maybe someone else can confirm that

But filing now might actually work in your favour as if she arrived July 5th, Sept 5th (very soon) will be the 90 days of authorized stay on a K1 and beyond Sept 5th she will be out of status and at risk of deportation.

Don't know if this is still relevant (it's been years for me) but the "manila envelope" she handed over had several papers in it. They give you back the portion they don't need (should be the DS3025 and the x-ray).

If the DS3025 is complete and correctly filled out (and your medical is still considered valid) you can put it in with the AOS package as a friendly reminder to the staff that you have had the required medical.

 

I had included the DS3025 and my AOS was approved. My "manila envelope" apparently never made it into my file. This missing paperwork turned into a major delay for my ROC.

 

Your options are (depending on what you find important)

- Search harder (and hope it turns up)

- Do nothing, send the AOS and hope the paperwork is in your file and correct. If it's not you most likely will get an RFE.

- Get a new medical (expensive but relatively quick). Submit with AOS

- Contact the Doctor in Italy and see if they are wiling to send you copies.
