How can you say it's a bona fide marriage when everything you have disclosed says otherwise? Do you think it is normal to not only not live with your husband, but to not even know where he lives? 

 

If he is homeless, who was paying for all these trips that you are using as evidence of marriage? And who is paying for your motel? 

 

I also note that you only mentioned physical abuse when you asked about VAWA and was advised there was no rationale. Do you have evidence of this abuse? Police reports? Witnesses? 

 

my thoughts to you is to go back to your home country. You probably had a better life there before all of this.

How do you think this is a 'genuine marriage'? Honest question, do you think that's normal for happily married spouses? It's really not. This guy has made it pretty clear he has no interest in seeing you, staying married to you, or in you staying in the US. There is no route to a visa for you from what you've said, I agree with the above - time to cut your losses and head home.

Regardless of anybodies opinion or experience on this forum, I think we can all agree on one thing in this case.

- This does not sound like a DIY case.

Changes of getting approved with a good (really good) lawyer aren't great, Changes of approval at this alone going are in the 1% range.

 

Old user gave you a link to find a local lawyer.  I suggest you spent the time before the interview getting a good one. We are not going to be able to give you the answers you want the hear.

This doesn’t sound like a bonafide marriage. What is your definition of a bonafide marriage? 
 

For your and your child’s sake, leave the US so you’re not in this vulnerable situation anymore and divorce your husband. Take control.
