Good afternoon everyone, I would like to ask you what the consular interview with the United States Embassy is about, since I have asked my wife and when checking our procedure a message appears that says that she is currently "in the visa office" so I understand that the next step will be the Interview. My wife has exceeded 180 days of illegal presence in the country, but less than 12 months, for which our lawyer has told us that she should apply for the forgiveness (which expires in September of this year). I would be very grateful if you could give me advice, tell me how the process works, etc.

Which consulate? Please fill in your timeline. You can search for interview reviews for your particular consulate which may help. 

 

Not sure what you mean by your lawyer says she should 'apply for the forgiveness', do they mean a waiver? There's no point in doing that if her 3 year ban will end in September, as the waiver takes years anyway so she's better off just waiting the ban out. When is her interview?

 I'm sorry, I'm new to the website and there are several things I don't understand yet, like looking for interviews from other people who could help me. On the other hand, I still don't have an interview date, but I know that it is the next step to follow, so I would like us to arrive prepared for that day.  The lawyer has suggested that I apply for a waiver but I understand that it makes no sense if the deadline is in September.

Visa's are handled by Consulates.

 

When did she leave?

 

Assuming she is eligible the Consulate will give her the opportunity of filing a waiver when refusing the visa due to the bar.

She left the US on the 2nd September 2022?

The interview is about your marital relationship and whether it is bona fide.  (Genuine)  Lots of information  here about interviews.  The simpler and least expensive option to deal with your issue of a three year ban, is to arrange for the interview to occur after that date.  You do not have a timeline, so we have no clue where your case is in the pipeline.  Has the petition been approved?  If so, when?  Are you Documentarily Qualified at NVC?  If not, have you made the payments and submitted civil documents and affidavit of support?

Facts are cheap...knowing how to use them is precious...
