Hello,

 

I've applied for my EAD whilst waiting for my i-485 to process. My i-485 is on "Case is being actively reviewed by USCIS" status at the moment but my i-765 has been stuck on "Case was received" status for the last 77 days. I also attended the biometrics appointment for it. Is this normal?

If you can look at your biometrics appointment letter, do you see the receipt numbers for both the I-485 & the I-765 listed?

Hello,

 

Thanks for replying. Short answer is I have 2 different letters with 2 different receipt numbers (1 for the i-485 and 1 for the i-765).

 

Just to clarify that when I submitted both applications but the i-765 got originally rejected due to incorrect fees. I re-submitted it and it has an independent receipt number, biometrics appointment and letter.

Just want to be sure I understand, you received two different biometrics appointment notices, one for each form? (because you had to resubmit the I-765) If that is the case, were the biometrics appointments on different dates and did you attend both? Or did you attend one and bring both notices?

Yes, they were on different dates and I attended them both and brought each notice for each appointment respectively. Also, seems that both of those applications are in 2 different centers right now. I-485 is in Chicago and the i-765 is in the NBC. The i-765 was mailed to Chicago but I guess they re-routed it to the NBC.

Yes the NBC usually handles all the I-765s. How long ago was the biometrics appointment for the I-765?

my husbands biometrics appointment was on march 18th and we have no had any updates for his I-765 either

everything has slowed down with the current administration.

so as of now, this seems normal, last i checked processing times according the USCIS for the I-765 was about 3.5 months.

I'm a firm believer that it can't hurt to go on "Ask Emma" ask to chat with a live agent and explain that your biometrics appointment for the I-765 was almost a month ago and the case status never changed to "Being Actively Reviewed" like it did for the I-485 and if they could check on it for you. We have done that before for our I-129F and for the I-485/I-765 when it was almost a month with no biometrics appointment scheduled. Both times we got movement on the case within a couple of days. Coincidence? Who knows? but using Ask Emma is free and open for anyone to use :)

Doesn't hurt to try. I usually don't get anywhere with these guys but I'll give it a try, thanks.

"Actively bring Reviewed" means nothing. Sometimes the status never changes. I've been a GC holder since 2019 and my i485 is still received. It means nothing. 

Please fill out your VJ timeline in reciprocity as it is completely blank. 

Your statistics help all VJ Members while we help you personally. 

A blank one helps no one.

Also if you can categorize/explain your situation to USCIS as one of the acceptable expedite situations, you can request an I-765 expedite.

I-485 expedites are rarely approved and may even delay your GC approval, so there is no sense in trying.
But I-765 expedites are possible, just check out our Timeline or our Profile->Immigration Info->Our Story.

So I've noticed around 2/3 weeks ago that I have put the wrong eligibility category in my form, which probably explains why my case is taking so long and stuck. I've consulted with a lawyer and they've suggested to send a signed letter directly to the center processing my application to try and correct this before I get a rejection but that doesn't seem to have visibly changed anything. I can't submit a case inquiry as my case is "still within processing time", which doesn't make much sense because it's been 3.5 months since the case was received. The Emma Live agents aren't very helpful either. Is there anything else I could do in this case?

Did you submit a letter?  If so, where did you send it?  All I-765s are processed at NBC (MSC).

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Yes, I sent a signed letter to the P.O. Box of the NBC alongside my i-797c of my i-485 and i-765 (which has the wrong category).  It was delivered to the PO BOX on April 17 according to the tracking.
