Well a visa is used to enter the US so not something she needs as she is here.

 

She will need a I 130 and I 601a, the kids may not need a I 601a, how old are they.

 

She might also be smacked with child smuggling which needs a I 601, so details as usual matter.

Well she has one 7 year old son in the US and the other two are in Honduras. Her other son is 8 years old and her daughter is 11. So even though she is here illegally, I only need to fill out an I 130 form and a I 601 for her and the son that are in the US?

How did they initially enter the US?

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Her ex boyfriend spent $20,000 to have them smuggled in. And she was a victim in the United States from that man. The state said they could help her if she did not have a place to stay and help her get her visa but now that she is married they cannot help.

OK.  Thanks.  I believe this is going to be a long process resulting in a trip to home country for consular processing.  She can't normally adjust status since she entered without inspection.

How old are they?

 

Assuming you can file for them there is the issue of the Father and I think they may be looking at their Mothers status. Who would take them to the interview?

I’m with Boiler, don’t really understand why you’d do it that way round. 
 

Say the children get a visa in 18 months time, they then have to move within a few months and make the US their permanent home. If your wife has to leave the US to get her visa, then it doesn’t make much sense to still have them in separate countries? And in the US without a parent?
