Hey everyone. I (US Citizen) am applying for a green card for my mom (living in India with my brother). The guy who is helping my brother apply for a tourist visa is telling us that a green card for my mom will be denied unless she has a current visa and has visited the US, 2 or 3 times and urging my brother to apply for a visa for her first. I am not seeing anyting like this in the USCIS website. Any help is appreciated. Thanks

Presumably the person who is helping is not a US Immigration Lawyer?

 

Best to avoid scammers.

Tell your Brother to run from that guy.  That guy, clearly, is clueless about US immigration.  I would predict he is equally clueless about US visitor visas.  He is full of misinformation.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

She is applying for a visa, always a first time.

Why does your brother need help applying for a tourist visa? Even if he does, he shouldn't use that guy to help him, he clearly hasn't got a clue about US immigration! Tell your brother to just do his own application, or to use a proper immigration lawyer if he really feels he needs help.

All you need do for you mon is send a I-130 application, you can do the application yourself, all you need is a uscis online account and the proper documents, it is very easy fill out the I-130

K1 2017

Aos sent April 2018

Aos interview July 2018

Work permit September2018

Aos approved July 24, 2019.

Roc April 27, 2021

Biometric reused june 28, 2021

N-400 online April 27, 2022 base on 3 years rule, biometric reused.

N-400 interview on December 12, 2022 combo interview i-751. Approved.

January 11, 2023 oath ceremony, Indianapolis. After that done with uscis😂🤭🤫

I took my oath ceremony in Indianapolis, it was a nice ceremony, where people from 35 coutry become american citizen.

01/11/2023 officially done with uscis :)

January 13, 2023 apply for us passport.( regular service).

March 11, 2023 passport in hand

Sounds like this guy is trying to get another fee by convincing your mom to apply for an unnecessary B2 visa (I assume he charges to help people fill out the DS160 form for a B2 application).  As others have said, run away from this guy as there have been many B2 "helpers" that end up screwing up the intending applicant down the road by doing things like saying the applicant is married when they are not.
