I am working in a remote position as an FP&A analyst for a US company. Currently I am working from Canada and all my team mates are in US. I am Canadian citizen and would like to move to US on TN visa. I have a bachelors and master's degree in accounting and over 8 years of work experience. I am a little nervous and wanted some guidance from those who have experience and been down this path. Thanks

Analyst could  be a problem, I think the job would need to be described as an Accountant.

 

Do you have a job offer.

I already have a job with this company and have been working from Canada for the past few months. 

 

I know a TN visa is a non-immigrant visa but I like to move and give it a shot by working from there. 

 

The article shared is in relation to those working in the profession of economist. Believe that does not apply as I have a background in accounting.

 

The following things concern me:

1. Is an FP&A Analyst seen under the profession of accounting?

2. My role is completely remote and all the other team means in the US work from home. Would this be a problem?

3. This is new to the company so no prior experience in providing letters for TN visas.

If it’s 100% remote, why would your physical presence in the U.S. even be needed?   That makes no sense.

The Company Immigration Lawyer will able able to advise on how to draft the letter, job description etc.

 

I assume that the Company is willing to participate.

The OP already has the visa and therefore US work & SSN entitlement.  That's how they are able to actually work for the US entity.  There are a number of Canadians that work for US entities this way.  

 

@HD_19 where is it that you think you want to live?  Moving to the US is an expensive proposition and is your employer fine with you moving, despite being in a remote position?  There are some implications for them with you being in Canada, so best to run it by them before you want to move.  Also, you might want to find out if they'd sponsor an L1 so in the future, if you did want to move and stay, you could potentially petition for a greencard.

My employer is fine with me moving but will not support with any legal cost at this point. This is new to them so not much guidsnce is offered. They said if I can manage to get TN visa they are happy to switch me to a US employee. If I can somehow make this work I like to go some place warm but that's secondary need to get this visa first.

Sounds like you are waiting.

 

Weird they will not cover the Lawyer costs when they are tiny compared to to putting you on the US payroll.

The actual TN process is incredibly simple once you qualify, the grey area here I suppose is the category that you would come under under the NAFTA professionals list. 

 

ACCOUNTANT Baccalaureate or Licenciatura Degree; or C.P.A, C.A., C.G.A., or C.M.A.

ECONOMIST Baccalaureate or Licenciatura Degree
MATHEMATICIAN (to include statistician) Baccalaureate or Licenciatura Degree

 

These are the 3 that stand out to me.

 

the actual process is easy and does not need a lawyer, unless they have the money they're willing to spend. Your employer needs to write a DETAILED letter that you can present at the border and be processed there. It should outline the work you will do, daily duties and responsibilites, the impact you will have, why you are the best person for the job, why you are a skilled professional etc. Then you bring your offer letter as well as copies of your degrees.

 

TN visas are granted 3 years at at time and can be renewed indefinitely.

 

The other option is H1B, which is dual intent. If your employer is CAP exempt, then they can file for you at any time. If they're cap subject, it won't be happening this year.
