Change of Address now or on I-751 Form?

Hello! 

 

I (USC) & my husband (GC holder) relocated to a new state in early 2023, with no pending petitions active with UCSIS. We never filed an AR-11 or I-865, frankly because it  never crossed my mind to until we received our notification that it was approaching time to submit my husband's I-751. Is it worth it for us to file the AR-11 & I-865 now, before we submit his I-751 packet, or just use our updated address on the I-751 packet? 

 

And yes, I recognize that there is not excuse for "forgetting" to submit the change of address to USCIS. It will now be added to all of my lists for addresses to change when moving going forward.

Yes, it's worth filing AR-11 and I-865 now. It's not a prerequisite for I-751, but needs to be done ASAP.

Do it now and on the I-751 packet.

 

We forgot to do the I-865 for my husband when we moved prior to the I-751, I think it's easy to forget about it. We weren't penalised for it being late at all, but it's better to have a record of you submitting one just in case questions are raised later.

To add to that:

 

AR-11 can be filed online. When you submit it you get confirmation instantly. Save it.

 

I-865 can only be filed on paper. You will get confirmation in the mail few weeks later.

I would certainly file the AR-11 and I-865 right now.  It takes minimal effort.

Can someone tell me if everyone has to complete the i-865? I am in a similar situation with regards to updating my address. I thought I had but I cannot find evidence to show it. Just completed the AR-11 online and noticed that this thread has mentioned the I-865? Does it get submitted with the i-751? I am working full time and not dependent on any welfare programs etc.

You may be confusing the I-865 (Sponsor’s Notice of Change of Address) with the I-864 (Affadavit of Support).

 

Cases here commonly involve a foreign spouse beneficiary married to a US citizen sponsor/petitioner, and in that case the change of address needs to be filed by both. The foreign spouse beneficiary completes the AR-11 (Alien’s Change of Address) and the US citizen sponsor completes the I-865 (Sponsor’s Notice of Change of Address).

 

You’ll have to decide whether that applies to you.

I honestly do not think that it does. I work full time at the moment. I do not rely on my spouse to support me and I do not claim benefits or welfare. Still confused by the whole matter. Do I just fill in the i-751?

The change of address form has nothing to do with your work situation or income, which is why I think you may still be confused.

 

As was mentioned earlier in the thread, change of address should be filed with USCIS as soon as possible when moving during the immigration process. Which form you submit depends on whether you are the noncitizen or citizen (to use USCIS terminology), but for married couples who change address it generally means one person files the AR-11 and the other files the I-865.

Ok, I submitted the AR-11 online (similar story to first poster) I thought I had completed it online already but could not find the evidence to back it up. After speaking to the bot, they send just submit another AR-11. I am the non US citizen. Does this mean that my spouse (US citizen) has to now also complete the I-865? Sorry for the silly questions. I appreciate your feedback and help.

All petitioners or sponsors who have filed an I-864 (in effect) MUST mail in an I-865 to report a change of address....within 30 days.
