Timeline

Hello,

 

When submitting the I-130 for my wife, I chose Cairo as that consulate that her application will be sent to. A lawyer told me that we can change this to another country once the I-130(Thailand) in hopes to minimize the NVC/Interview process time.

 

Is there any legal implication in doing this? I was told that there's not (and it sounds legit), but I wanted to double check.

I think you have confused us, where does Thailand come into this.

The reason the lawyer suggested going to Thailand is because you are allowed to enter Thailand with an Egyptian passport and the processing times are much shorter than Cairo. Otherwise, no other connection

Would the Consulate in Thailand accept the transfer?

What did your Lawyer say? Presumably there is some reason for the suggestion.

He said as long as she's able to get in the country, then there's no problem.

When we requested a transfer from China to Japan we had to prove my wife was a resident in Japan before the the embasy in Japan agreed to take it. I also had to get the help of our Representative's office involved to push the trasfer along.

Response 2: Feb. 18, 2020 - Tokyo Embassy - Requested transfer fm China - Case moved to Administrative Processing 

A Short Time Later after talking with Rep. Case's office, they contacted the embassies again. 

Response 3: Feb. 21, 2020 - Transfer complete; New interview scheduled.

 

Interview Date: Mar. 2, 2020 - Tokyo Embassy 

Interview Result: Approved

Visa Issued: Mar. 4, 2020

Visa in hand: Mar. 6, 2020

 

Time: ~359 Days from start to finish 

POE:  Stupid COVID-19 delaying travel to the US....

POE: Aug. 13, 2020 - San Francisco 

 

SSN: Oct. 23, 2020

GC: Aug 5, 2021 (51 weeks from entry)

 

I-751

NOA1 - May 20, 2022 CA Service Center

NOA2 - July 20, 2022 Case Transfered to NBC

NOA3 - Mar 6, 2023 48 month GC extension letter

NOA4 - Sep 1, 2023 Biometrics Appointment 

Update - Oct 6, 2023 Case status update to show fingerprints taken

Yes, she needs something more than just visitor status, BEFORE even requesting the transfer.  Lawyer doesn't know what they are talking about.

Best to look for a more competent lawyer.
