Hi,

      I plan to file a 1-130 form for my wife, who is a Pakistani national. However, after our marriage, she changed her last name on her passport and ID card, which means that the name on her marriage certificate and her passport/ID card does not match. Please advise me on what proof I must submit for the name change.

The marriage certificate will function as a legal name change document for USCIS.  Fill out the forms in her new married name, and you should be fine.

                          After getting married, my partner took on my last name. However, the marriage certificate still shows their previous last name, while their passport and ID reflect the name change (where it shows she took my last name).

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

Correct, because her name change occurred AFTER (or at the same time as) the marriage, not before.  Jane Smith married John Doe to become Jane Doe.  Not an issue.

A related question, in Paksitan, it's pretty common for wife to take up husband's first name as her last name. 

Jane Smith married John Doe and became Jane John. Would the marriage certificate showing full name of the husband and wife's maiden name be sufficient? Should we leave the interpretation of how wife got her last name upto USCIS? USCIS may assume that it's the last names of the husband and wife usually match is she changed her name after marraige but this may not be the case for some from Pakistan.

 

Anyone in similar situation who has dealt with this and how did it turn out in the end? Thank you!
