Yes, they go by the date you didn't show up for the interview, the status is terminated from that date as that's the date you "abandoned" your case by not showing up for the interview. They don't pick a random date on their own, it goes by the interview date. That's just how it works, no matter if you like it or not.

I wouldn't trust that, if you have only been told this over the phone by the "customer service" disinformation line (ie Tier 1 and 2). But I hope for your sake it's correct so you can move on from this not having to start over. It wouldn't be the first time someone gets their case reopened after missing an interview due to not receiving the letter, although in your case it has been a very long time.

According to the online uscis account the receipt number is pending and interview is in the que to be rescheduled.  The only way I was able to see the denial posted above was through an foia

We are seeing internal documents snapshots of a receipt number that was on its way to a denial but isn't and wasn't denied due to being in the que to being rescheduled

Where do you get the idea that this is an “internal document”, when it’s addressed to your wife and it has the date of the interview as the date of the denial?
And why do you trust the online notifications instead of the denial LETTER (not document) that was given to you as a result of the FOIA?

Wouldnt it make sense to think that the online notifications are lagged?

Also you asked what kind of immigrants can afford a lawyer.. not sure why you ask this or how it is relevant, but some immigrants make good money, either them or their SOs… and some lawyers offer payment plans. But I digress.

And for the third time what does your mom think?

If I were in your shoes, my concern would be that you wait however many months for the I-751 interview to be rescheduled, and then when an officer finally picks up your file to schedule your interview, says, "What doofus put this in the queue to be scheduled for an interview; it already has a denial notice?  I can't schedule an interview for a case that has been denied."

And then at that stage you will have to argue that it was denied in error due to USCIS never sending the interview notice, or sending it to the wrong address.  Hence why you should gather as much proof as you can that you were in the right, and USCIS in the wrong.

I may be proven wrong, but I can't imagine USCIS just glossing over the fact that you missed your original interview.

Only relying on online notifications is not smart. Nobody here is doing that.

Example: the n400 was denied on the usciswebsite/and i recieved a denial letter pertaining to the n400 receipt number/and uscis officers can see and verify that the n400 is denied.

When I spoke to the tier 2 she could see that I missed the interview on May 7 2021 and she still put a service request to have it rescheduled.  That tier 2 said it wasn't denied, the words that the uscis officers use is "hold" you guys are insisting the correct word is denied, I dont control what terminology you or the uscis choose to use.

Tier 2 stated that she can see a missed interview and she said she could put it in rescheduling que.  Last uscis officer and online update states that request to be rescheduled was completed. Uscis officer states completed means its in the que to be rescheduled

What are your explanations as to why nobody at the uscis is using the word denial and they all state the receipt number isn't denied.   I personally don't care which word is used since the interview is being rescheduled

Internal document meaning I could only see it by specifically saying I want to see it.  It was never sent out. Mom says wait for it to be rescheduled.

Correct missing an interview starts the denial process.

I simply believe that the Tier 1 and Tier 2 officers who operate the 1-800 help line have a very different role than the officers who review the cases, and the officers at the field offices who conduct the interview.  I imagine it within the realm of possibility that some officer later down the line may have the authority to contradict/override what other USCIS agents may have told you.  I'm not saying this will happen, but I imagine it's possible.

I hope for your sake all goes well, but if I were you, I would be prepared for the worst--having to argue against a wrongful denial--and hope for the best, just in case.

We are prepared.

I doubt that uscis officers Tier 1 and 2 can say the same thing and all be wrong, including online notification status stating the same as they say.  They all can see the missed interview and they all say the receipt number is not denied and that it's in que to be rescheduled.

They all state that a denial is something they all would be able to see.

Whether it was or wasn't denied, if it's back in the que to be rescheduled then it's a moot point.

I have a current service request for an officer to look at what is taking so long to be scheduled.
