Copy of denial letter I've seen with my own eyes earlier today from your screenshot.

If you didn't ask for a copy of interview letter in FOIA request, USCIS wouldn't give in their response. Simple.

That looks like an official denial letter that is typically sent out??? What is that date stamp for? Can you provide examples of sent out denial letters to show that this is how they usually look (with a date only stamp)

 

And why was this hidden from both petitioner and every uscis officer that has looked at this case??

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I think the denial letter was created by USCIS in 2021.  However, proving the letter was actually mailed from USCIS and/or received by you is the impossible part.

It appears that the only change of address for the case occurred on January 10, 2022.

 

What date did you move, and what date did you submit the AR-11 change of address form?

 

Double-check what exactly your FOIA request encompassed.  If it did not explicitly ask for interview notices, or all communications and records pertaining to your case, I would recommend that you submit another FOIA request specifically requesting all records.

 

If you can prove that you correctly submitted the AR-11 before November 3rd, 2020, when they scheduled the interview, and FOIA turns up an interview notice addressed to your old address, then you have the smoking gun that USCIS is at fault.  If it turns up an interview notice with your new address, then you're probably dead in the water, as USCIS can then shift the blame to you.  If it turns up no interview notice at all, then that will be in your favor.

 

I notice that the online notification states that on March 8th, 2021, USCIS cancelled the interview that was scheduled on November 3rd, 2020.  I'm curious if that cancellation letter will turn up in the FOIA request, and what address it will have on it.  I am assuming that you never received that letter either.

The way it looks to me:

1. OP's wife filed I-751 jointly at old address

2. OP and wife moved to new address. Whether they correctly filed AR-11 or not hard to tell without proof.

3. USCIS sends an interview letter to old address on file (my assumption), which OP and his wife did not receive, since they lived at different address

4. USCIS sends denial letter to old address on file. Again, OP and his wife didn't receive it

5. Meanwhile OP's wife gets I-551 stamps at local field office

6. OP's wife specified new address in N-400 application

I sent screenshots of all of the online notices regarding thos i751.  No notification of interview letter sent, and no denial notice online or sent.

Nope no copies of interview notices sent to me in the foia.

Did you ask for it? And if you did, was it done properly? That's the reason sometimes people hire lawyers instead of trying to do it themselves.

Yeah and multiple tier uscis officers and multiple service requests state that it's in the que for reschedule and it's not denied.  Multiple people making the same mistake is more unlikely.
