I'm filing Form I-864 and I have a few questions.

 

Question 1: Page 4.

I have been putting "N/A" in almost all the boxes that doesn't relate to us. However, in the instructions, it says to put "None" if it ask for a number. For Current Income, should we put "N/A",  "None", or just leave it blank? Also, we put "N/A" for name and relationship on the top.

 

 

Question 2: Page 5.

I might not be able to finish my 2022 taxes on time before I submit this I-864. Can I just put my 2021 as my "Most Recent" tax year?

 

 

Question 3: Proof of domicile

I have been currently living in South Korea since 2017. I'm going to move in with my mom. All my mail from the United States goes to my mom's address. I believe I need to show proof of domicile. 

Here is what I have and what I'm planning to send with my form I-864. I was wondering if this is good enough? :

1) Credit card and debit card statements that has my permanent address (Mom's address). Also, I can print out the statements online.

2) Show them that I'm looking for a job in the US.

3) Write a letter on what I will do (work, school, etc.)

4) I'm planning to message an elementary school for registration for my son.

Have your mom write a letter that you both sign showing she is going to let you live at her address when you repatriate.

If you are able to actually enter N/A in a field, then you are not using Adobe Reader or Acrobat.  Stop and start over with one of those, so the form will function properly.  You do NOT need to enter N/A.  The form won't even accept that.

 

You also can't enter NONE, but you can enter zeros.

 

The year you sponsor your spouse is not the year you delay filing your tax return. It's the year you file it as soon as possible and delay filing the I-864, if necessary.

 

Get the whole idea of any "Can I just...." question out of your head.

Domicile proof for NVC will be fine. 
Seoul might request additional information/ proof at the interview (they did for us).

Complete your 2022 taxes and submit it. Make sure to keep copies of your taxes because Seoul requests hardcopies at the interview. 
You might not receive your transcript in time so upload statement of no W2/1099 if you submit the 1040 and 2555 in place of transcript.

Many fields are applicable, even if the answer is Zero or "none".  A properly completed form is done using ad Adobe product, which does not allow N/A to be typed in number fields or almost any fields.  If a section is N/A type Not Applicable in the first field of the section and move on.  Any software not from Adobe will cause problems with these forms.  Adobe Reader is free.

I'm going to submit my taxes this weekend. Do I have to wait for the IRS to approve my taxes before I can put it in I-864? Or can I submit my taxes and then put it in form right away and submit I-864 to NVC?

No need to wait.  You will submit the complete tax return, with all schedules, W2, and 1099 forms.

I have a couple more questions:

 

Question #1. It's about the bank statement because I will be using assets. I got a "Certificate Of Deposit Balance" to get how much USD is from my Korean bank account and I will also add whatever I have in my US bank account. I added both my Korean Bank USD Certificate and US bank to get a total that I will enter in Part 7 Number 1. I will submit the Korean Bank USD Certificate and a US bank statement to show proof of my assets. My question is, can I just submit my latest US bank statement for proof on how much money I have in my US bank? Or is it better to submit more than one statement from my US bank?

 

 

Questions #2: This might be a very silly question. But how can I write a statement that I don't have a W2/1099. Is what I have below acceptable?

 

Title of letter I will submit: "W2/1099 and use of assets explanation".

 

NVC Case Number: (something here)

Invoice ID Number: (something here)

Name: (something here)

Date: February 23, 2023

 

To whom it may concern:

This is Dante2019 (petitioner). I am writing this letter because I don't have a W2/1099 because I currently live and work in South Korea. We are not given W2/1099 forms. 2) Letter of intent to re-establish domicile. 

3) Letter explaining that I will use assets as I live and works abroad.

 

Does anyone have any opinion if this is a idea to do?

Because your affidavit will already show zero income and qualifying assets.  They know.  They can see.  The letter is not needed.

I just re-read the instructions. I just want to double check. Since I can't submit a transcript of my 2022 taxes to NVC. The only option is to send a copy of my 2022 taxes that I will submit to the IRS in a day or two. Since I don't have a W2/1099, is it correct to submit a copy of my 2022 taxes and an explanation on why I don't have a W2/1099?

 

The reason why I'm asking this question is because in the instructions it says if I'm not submitting a transcript, I must submit a copy of my 2022 taxes with my W2/1099 (which I don't have because I work abroad).
