Hello,

 

My spouse and kid are USC's and I am an Indian citizen. We had moved from US to India almost 12 years back. Now, we all are planning to move back and I was wondering, if we would qualify for filing I-130 through DCF? We do not qualify for any Exceptional circumstances listed on USCIS website.

 

Also, I understand, we would need to show substantial US income in I-864. Can this be my brother, who is already in US and working there?

Currently, my wife (the petitioner) does NOT have a substantial income source to support. We also do NOT have any joint asset in US, but we do have an asset in India.

You answered your own question, if you do not qualify according to exceptional circumstances, then you have to file the regular way.
