K1 petition sent to Nebraska has been moved to California by them - why?

Hi there! New member here, reading all, learning and trying to work out all these acronyms....eek!

So I am pretty confused. My fianceè lives in Wyoming and therefore he was told to send his K1 petition to Nebraska.

Days later he was informed that the California USCIS processing centre confirmed receipt of his application. That's not good as we learned that California takes 14 months while other centres take much less.

Are we missing something, and is here a way to move the petition somewhere else? 

Thanks for your patience - I read about 40 pages of the forum before asking this question but I could not find an answer.

we send petitions to a lock box location

they process the payment and assign the office that will process the stage 1 of the petition 

 

If California is overwhelmed with new petitions ,  they could send to Texas or another office but that is up to the office in charge

Every couple has their own priorities, and each couple must decide which visa is better for their situation.

K-1        
    More expensive than CR-1    
    Requires Adjustment of Status after marriage (expensive and requires a lot of paperwork)    
    Spouse can not leave the US until she/he receives approved Advance Parole (approx 6-8 months)    
    Spouse can not work until she/he receives EAD (approx 6-8 months)    
    Some people have had problems with driver licenses, Social Security cards, leases, bank account during this period    
    Spouse will not receive Green Card for many months after Adjustment of Status is filed.
    A K-1 might be a better choice when 18-21 year old children are immigrating also
    In some situations, marriage can affect certain Home country benefits, making a K-1 a better choice   
    A denied K-1 is sent back to USCIS to expire
    

CR-1
    Less expensive than K-1    
    No Adjustment of Status(I-485, I-131, I-765) required.    
    Spouse can immediately travel outside the US    
    Spouse is authorized to work immediately upon arrival.    
    Spouse receives Social Security Card and Green Card within 2 or 3 weeks after entering the US    
    Opening a bank account, getting a driver's license, etc. are very easily accomplished with GC, SS card, and passport.
    Spouse has legal permanent Resident status IMMEDIATELY upon entry to US.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Who told him to send it to Nebraska? Just curious where that advice came from.
 

 Did you read this page of information from USCIS? Please open the link https://www.uscis.gov/i-129f

If you look down the page you can open “Where to file” and it shows all K1 petitions go to Texas. So from here on out my suggestion is read everything you can from the source, USCIS, including every word in the instructions for each form which they always post, along with fees, etc. Your wait is going to be a long one, so do all you can to get each step right from the start so an RFE (Request for Evidence) doesn’t delay you. 
 

From what you say, your petition landed at California so that’s where it will stay. A least they didn’t send it all back and say start over and submit to the proper place. You can’t request a move to a more favorable center. Sometimes USCIS moves batches to balance out the loads but you have no control over that.  Good luck on everything going well for you.

We have sent the petition 3 weeks ago, and we just found this forum. We read about both experiences. For many reasons, we could not get married in the UK and use the other method. He must stay in his country where he teaches. He cannot come here. If his family doesn't attend the wedding, I will just be landing there as a total stranger. So we chose K1. This is not what I am debating.

The form he was filling did not leave him any other option but to send it to Nebraska. I am no catching up on the reading - just joined this forum. Sad to hear that the petition will stay in the busiest processing centre! Thanks!

I am 100% sure my boyfriend read and understood the instructions correctly, checked everything and saw nothing saying to send his Petition anywhere else but to Nebraska. He is conversant with understanding complex instructions and has taken 3 weeks to read, understand, find documentations, check and then re check everything. He is thorough. This is why he is surprised that despite being told to only send to Nebraska, his petition has been moved to California.

He cannot request a petition transfer.
