I can see some IOs not liking the fact they rented two apartments at the same time, even in both names. That alone should be rectified.

I was in status. Our backgrounds do not raise a huge red flag (I changed it here for anonymity). My spouse did not sponsor anyone, but she was married before. The apartment issue is understandable, but we have plenty of travel history, and ID'd are pointing to the same address.  I don't think that is a big issue, given that are main address is the same and we do have tons of bus tickets/amtrak/ plane that shows travelling together back and forth.

@Rocio0010 Please note, I never said it's impossible to do on your own. Almost everything in life is doable on your own. Some examples:

* DIY home renovation vs hiring contractors

* Giving birth at home vs in the hospital

* Learning language yourself vs going to classes

* Growing food in your garden vs buying produce at supermarket

 

I'm just saying it's very important time in OPs life. If money isn't an issue, it's an option to have.

 

Let's try to help the OP instead of discussing whether the lawyer is needed or not.

What about joint utilities? That'd be better, more concrete evidence than the bus tickets...

Bank Statements and Joint Investments all point to the same address. The tickets were in response to show coliving and cotravelling

Talking of plus points she is on the hook for the I 864 and I assume Student Loans, so good negotiating points.

 

I can only recollect 2 people who failed to remove conditions, one admitted in writing the marriage was for an Immigrant benefit, the other disappeared a few weeks after entry and moved in with his GF.

 

There have been hundreds of posts from disappointed USC's who want to get their ex deported.

I am not too worried about my (our) I751 getting denied. I have seen some very weird cases getting approved and to your point unless there is a VERY clear evidence the whole thing was a sham it's hard to prove otherwise (the I751 Denials due to fraud is very low as you are also well aware and most are due to incorrect info, wrong timing and not providing divorce decree in time,etc) but I also know that there are so many cases (Relatively speaking) whose 751 got approved after a 4-5 year struggle. Now I don't think my spouse will write to USCIS given she is on the hook for 40K of loans and some joint assets  (I obviously can't hold back her portion but things will go UGLY for both parties) but I do have a professional career and the last thing I want is for this thing to drag longer than it has to. 

We did enter the marriage in good faith and our IO was very very cool during the interview and kept saying sweet stuff about us, there is nothing weird about our case and we dated for two years prior, I am trying to make this case as straighforward as possible. 

 

As for the marriage itself it has led into a weird toxic / codependent state that sadly is also the very biproduct of a "normal bonafide marriage" or else there would be no negative emotions floating around while being emotionally attached.

@Dude41 even a straightforward "married filed jointly" case nowadays can take 12-24 months to get approved. In your place I'd focus finalizing the divorce and filing I-751 accurately with a lot of evidence. The processing times are our of your control. You have a valid status for all the years I-751 is pending. Worst case, you would be getting I-551 stamps in your passport every year after extension letter expiration. But this doesn't limit your ability to work, travel etc.
