Immigration Guide for Bringing Children

We completed I-130 for my husband in India in which that forms also indicates his children - now 17 and 22 (when we began the process they were 16 and 21).

My questions:

Because they were 21 or younger when we began the process, what forms would be needed?

Basically, would they be included on my husband's I-130?

Or is the I-130 required for each family member?

Would I indicate all 3 (husband and the 2 children) on the I-864 under Part #3?

Thank you in advance for any information or assistance you can provide.

How old were they when you married?

Yes they need individual I 130's assuming they are eligible.

A U.S. citizen or LPR stepparent may petition for their stepchild to immigrate them or adjust their status if the stepparent married the child’s birth parent before the child’s 18th birthday.

read all the rules reguarding age,  etc

If you are a USC, then 1 I-130 for your husband, and 1 I-130 for the 17 year old.

The 22 year old is too old for you to petition.  It is not their age when you started the father's petition, but their age when you started their individual petition.

If you are an LPR, then 1 I-130 for your husband and his children can be derivatives.
