So I sent the petitions for the K-1 visa, there was in issue. The USCIS sent my forms back and it said the application or petition cannot be accepted because the proper fee of $170.00 U.S. is not attached. Now my issue is the money order I sent was of $171.00 can I deposit this in my bank account and just write the USCIS a check? and the other is should I fill out the I-129F Petition since it has this red mark on it? I'm kind of pissed why did they make such a big deal about $1 extra :wacko:

See if you can get the MO refunded, and just use a personal check, you can track personal checks, and you should be able to resend in the I-129F, but if concerned just reprint the form.

Use a personal check. I know that I did that and it was nice to know when they cashed it.

should resend it asap as fees are going WAY up at end of this month i think and your's is not 'received' yet

The advantage of a personal cheque is that you can read the case number from the back of it when it is cashed because they don't always send you and NOA1 with the case number.

Thanks, everyone for the advice. Sorry that happened to you but please read and re-check all documents.

Now my question is this for the ones who went thru K-1 before. My fiance is in Egypt. We meet in 2001, but it's only now that we want to marry, low and behold we can't legal marry there. We have never met and will meet for the first time in person on July30 2007. Can I send the I-129F forms say 31 July 2007? This was actually suppose to be our wedding date, but since we can't legal get married now I have to fill the k-1 visa. Would it be a problem for me to send the forms from Cairo on the 31July 2007? I mean we would've met in person "within" two years right?

Also, if I was unemployed due to illness, and now able to go back to work how will I prove the financial stuff. I mean, people will get ill or lose jobs and it's not their own fault. Can I get a friend to sponsor him if I'm not working full time? what if I'm working for temporary agencies but full time? Is this considered good enough for INS? Anyone dealing with SSI and a co-sponsor?

Well, that aside, you will have fulfilled the requirements of meeting within the 2 year time frame prior to filing the petition. You must consider, however, how you can document this meeting in person sufficiently to convince USCIS that it occurred. That may be difficult to do in 24 hours. If I were as determined as you seem to be, I'd consider the idea of a photo of the two of you, in front of a well-known landmark, holding up that morning's English-language newspaper. And other things like your boarding passes, passport stamp(s) maybe a few more photos, and anything else you can think of. That will show USCIS that you met in the proper time frame.

Now proving to the DOS (the Consulate at interview time) that you have a real relationship... that is a little trickier. They might have some questions about the timing of things. Do you have lots of evidence of your relationship?

And excuse me for asking, but what's the big rush??

Thanks for your response! We actually were introduced by my dear friend since 1998, I like a dummy left him and got married to someone else, big mistake on my part. LOL! I contacted him a few years ago, we started talking again and now we have decided to marry. Only problem is we have never meet face to face. It's the weirdest thing(life is strange) so anyway we have known each other since 1998; so yes, I'm rushing..lol!

Now, so are you saying it's possible? he is kind of like the old boyfriend from high school that you didn't marry, and after meeting again at a class reunion you thought, "why not" hahaha! Only problems is we just never met face to face.

It sounds like you are rushing into this to save on the fee increase. If you are serious about this, then take your time. You've already said that you had one mistake in marriage, so slow down. The increase in fees is not a reason to rush such a decision.

You want to be sure about everything as does he. Go meet him, spend a lot of time together and see what happens when the two of you are together alone. You can get lots of pictures of the two of you together, get plenty of documentation of your trip and get everything necessary to file for a K-1 visa.

You will also give yourself time to secure a better job and thereby show the ability to support both of you. This is a really important decision and you shouldn't jump into it without some caution.

Let your heart guide you, but allow the head to make decisions.

It is physically impossible to meet for the first time on July 30, 2007 and beat the fee increase deadline. However, it is absolutely possible to mail the petition July 31st. You would probably find yourself occupied organizing papers instead of enjoying yourself but the decision is yours.

I don't understand the need some have to offer relationship advice to those who don't ask for it. We're all adults here and if we're not, we have other adults to preach to us that actually know us and our circumstances.

Facts are cheap...knowing how to use them is precious...

On your MO, you can try taking it back to the place where you purchased it and see if they will refund it. We had a similar problem filing for AOS where the money order was for too much. No one would cash it because it was already made out to USCIS. And as mentioned above, a personal check is a great way to track your money/case.

As far as filing, I personally think you're pushing things a bit. I can completely understand your desire to get things underway ASAP, but cutting things so close may invite and RFE and delay your case. It is possible for you to meet face-to-face on the 30th and file the petition on the 31st, but it may not be all that easy. You will only have one day's worth of evidence to provide as proof of meeting and the person who winds up working your case may not find it sufficient. And if your only evidence shows you meeting one day and filing the next, it may look like fraud to an adjudicator. Mind you, the purpose of the petition is to get your foot in the door and get an interviewed scheduled, leaving the major evidence piles for the interview itself. But if it were me, Id try to build a little stronger case for myself before sending it off to be reviewed by USCIS. As mentioned above, a photo showing both of you and a dated English newspaper is a great way of placing you together at a certain time. Try to include some other evidence spanning the months up to your meeting, like personal snail mail correspondence, emails, internet chat logs, and phone records. I would also include a short statement about how you have been corresponding for several years prior to meeting, to help build your case as well. Have absolutely all your paperwork, with the exception of the evidence you will aquire upon meeting him, ready to go in the envelope before you leave for Egypt because you may not be able to fix it if you get there and realize you've forgotten something.

On the income issue, as long as someone is willing to sign the affidavit and say they make 125% of the poverty level and will take financial responsibility for the K-1 beneficiary, you're fine. It doesnt matter if you work full or part time, if you have 1 sponsor or 3, as long as you can prove that your fiance will not become a charge of the state. If you aquire a better income by interview time, you can drop your co-sponsors and do it all on your own.

I just wanted to make sure I could send the forms in. I don't care about deadlines or anything, just wanted to send the forms in.

Just include a few things. Enough to prove you've met in person and have known each other for a little while. Save the massive piles for the interview. I sent copies of luggage tags, boarding passes, photos, emails, chat logs, phone records, copies of rcpts for things I bought in Morocco, copies of passport stamps, etc. You are just trying to place yourself in the same place with him at the same time. You only need a few pieces of evidence to get the job done.
