Consulate asked for I-864A. Very confused - please help

Hello guys, I am having a little confusion regarding my spouse’s IV documents and hoping that you can in a position to navigate me through this process.

 

So recently my spouse had IV interview at U.S. consulate overseas and CO has asked for updated financial documents to be submitted via NVC portal. When we originally submitted documents to NVC they were 2020 docs and it is totally understandable that they are asking for 2021 instead, but they have also asked for I-864A.

 

Now here is where I get confused:

 

Here’s what I have submitted before (2020):

 

My I-864 (petitioner) & W2’s (my income was low and we have used one joint sponsor)

Joint Sponsor’s I-864 & his W2’s

 

This year I was my father claimed me as dependent in his taxes because I had no income. My spouse presented these updated documents (I-864 and 2021 taxes) during his interview, but CO asked all of these docs to be uploaded on NVC and I’m not sure what triggered requesting I-864A but either way I’m not sure what should I do. Joint sponsor’s updated income didn’t change much and he is single on taxes, claims nobody so I have no clue how I-864A came into play. Who should fill out this form? Is it supposed my father because I'm claimed on his taxes even though I'm not a main sponsor?

 

I am pretty confused and any help would be very much appreciated.

I'm guessing they want an I-864a from the joint sponsor's spouse.  Is that correct?  If so, it has always been the best practice to provide one.

Facts are cheap...knowing how to use them is precious...

I just completed my wife's I130 for her mother.  

 

Her line of work does not show a lot of income.  I am joint sponsor and filled out the I-864A.  I caught that part luckily because I had completed an I-864.  

 

I think if your joint sponsor is sufficient than you need an I-864A

Thanks for response. Just trying to wrap my head around this - so if I'm getting this correctly - joint sponsor has to fill out both I-864 and I-864A? Just as a side note - joint sponsor is not married nor has any dependents.

That's the tricky part - joint sponsor is single, not married, no children and no dependents. I am not sure why 864A was requested..

When Consulates ask for an I-864a, they say who it is to be from.  A single joint sponsor does not provide an I-864a.  Only a person married to or household member combining income with a joint sponsor would do that.

Consulate asking for the for from whom?  What is the exact wording you are seeing that makes you think this?

Timeline

You were claimed as a dependant on your dad's IRS tax return. So you'll need your own I-864 as main sponsor, your dad's I-864 as a joint sponsor and your I-864A since you're named in his taxes. 3 things in total. Should solve the problem @renzy.benzy

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

You mentioned though that you are a dependent on your dad's taxes. So, the joint sponsor DOES have dependents.... (I would clarify with the CO) but it sounds like you should be filling out the I-864A.

1. Your Joint Sponsor is ok with what he sent , I-864 and financials since he is both single and claims no dependents. 
 

2. You need to do / update an I-864 as the Petitioner/Sponsor and oddly enough have your father do I-864 A as the household member ( because you show up as dependent on his taxes )….

Is it requested on the ceac portal, on a document they provided, or did the CO say that during the interview? If it was said verbally during the interview, may be the CO was simply relaying info about the i864a as well in case of joint tax return from the joint sponsor and not necessarily asking for it.
