You are right! We should not be suffering only because we had to apply through Montreal consulate and we should not be waiting ~2 years while others are only waiting for few months. We really need to figure out, as a group, what to do to change it. Any ideas?

I suggested a petition, but that seems to not have worked before! Not sure if contacting the Embassy in Ottawa, or Department of State would yield anything. They mention MTL is the only post with trained staff on IVs, I was hoping to push them to provide more resources even perhaps in other posts to reduce the backlog.

I know that previously people have tried to sue them using the writ of mandamus, but that didn't work either and costs a lot for lawyer fees. 

No idea how we can speed anything up. It's very frustrating considering we are already approved and this is just a glorified document check.

Hi All,

Please stop nonsense conversation about suing them, acting against them etc.. they are doing the favor of issuing visa in a way they want to or afford it. Save space in this forum for some useful comments and updates. If you don't like it change visa office or find a different category with faster processing time.

1- Please be respectful - telling others what to say and what not to say is "nonsense".

2- You can decide to not read what you don't like

3- The forum does not get "full". There is space for all respectful discussions

4- They are not doing "us" a "favor"! It is the LAW of the US, a country that is built based on lawful immigration!

5- No one was going to sue them. The previous comment mentioned others had previously done that, to no avail. We are trying to find ways to push them to provide additional resources to clear the backlog quicker. Do you have any problems with that?

6- I question your approach to fixing problems. Instead of finding solutions, you propose changing the entire issue? Instead of fixing a backlog, you suggest changing the Visa Category??? lol

All, some historical analysis on the EB-2 visas issues by MTL per month - July 2023 is an outlier.

On page 1 of this thread 3labmom was discussing their ongoing lawsuit using the WOM. This is not a new topic. And they are now in the US. So perhaps it is a very reasonable thing to discuss. Perhaps read up on the purpose of the WOM - it is to get action within a reasonable time frame, which is not happening. Hence why this is a valid action to take.

There was more E3 priority during the pandemic as there were many health workers in that group. With some getting an interview within 3 months. But since then there doesn't seem to be much rhyme or reason.

Every day I open this site in the hope that a whole bunch of people have been invited for interviews. And every day I am so disappointed. No interview letters since may is just mind boggling.

Any know the logistics of, or if you can keep your current job (in my case Canadian) while you activate the green card, get a SSN and start job hunting in the US? I guess from a tax perspective you become a resident of the US when you cross the border. It would be ideal to keep my current job until I secure something good in the US but I have a feeling it’s not possible.

Not quite sure, but the biggest thing would be tax. Yes, you need to determine which country you are a resident of, from the Tax perspective. Will you need to commute? Where will you live while on the job hunt?

I have a second home already in the US. I can job hunt online so could keep physically working in Canada while I send out resumes. Would need a good accountant though.

Yup, you need someone who can figure out the taxes properly. Also, beware of the Green Card requirements. There are two different but related requirements for physical presence and residency...
