Timeline

A couple months ago I received a RFE and I submitted it and then after received a NOID. Just received an update today. What do you think it is. I’ve already sent in a RFE and also NOID all the paper work they needed. Now not sure what else they may need. Could it be a denial or even a approval? 

On May 22, 2022, we began reviewing your Form I-130, Petition for Alien Relative, Receipt Number. We mailed you a notice informing you of the action we intend to take on your case. Please follow the instructions in the notice and submit any requested materials. If you do not receive your notice by June 5, 2022, contact the USCIS Contact Center at www.uscis.gov/contactcenter. If you move, go to www.uscis.gov/addresschange to give us your new mailing address.

What was the RFE for?

How did you respond?

When did you respond?

Did you respond after it was due/ did you send RFE via registered mail?

NOID= Notice of Intent to Deny

If you did not respond to the RFE in the correct/ timely manner you might have to re-apply....

Doesn't seem an approval based on the wording. May be NOID again?

2015-06-16: I-130 Sent

2015-08-17: I-130 approved

2015-09-23: NVC received file

2015-10-05: NVC assigned Case number, Invoice ID & Beneficiary ID

2016-06-30: DS-261 completed, AOS Fee Paid, WL received

2016-07-05: Received IV invoice, IV Fee Paid

2016-07-06: DS-260 Submitted

2016-07-07: AOS and IV Package mailed

2016-07-08: NVC Scan

2016-08-08: Case Complete

2017-06-30: Interview, approved

2017-07-04: Visa in hand

2017-08-01: Entry to US

That will not be an approval.......They don't notify you when they intend to approve.....they just approve.   It sounds, to me, like another NOID....or a NOIR...or a denial.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

RFE was for i-130a it was missing I submitted but something was missing so that’s when they sent me a NOID to correct the I-130a and I did send Send it registered mail both on time.

We’ve been married 10 years 2 kids so not sure about NOIR. But can a NOID be sent out a 2nd time? Also if it was denied wouldn’t they update it on case tracker?

Are you filing for consular processing or are both of you in the US right now?

You might be asking this question in the incorrect forum... 

There might be something missing if you are planning to adjust status or ....

Maybe.....Either way, something is wrong.  Let us know when you receive the hard copy.

NOID is notice of intent to deny

to appeal a NOID u must present actual proof that the reasons for the denial is wrong 

Examples the notice says u have not met in the last 2 years before filing the petition and u have proof of boarding passes within the time and photos from that trip to be together

 

u can not just say "that issue is wrong or not true"

   u must have REAL proof that any issue the officer has with your petition is not valid 

 

It is doubtful they will reconsider and the appeal takes more than a year

best to reapply and when u receive the NOIS , address the issues in the next petition or at interview

How do i know?

i did an appeal and won as i had the necessary proofs (this took over a year pre covid)

and my letter from the Immigration Court of Appeals said "marriage is bona fida and i could reapply"

 

What can you do? Receiving the denial notice issued by USCIS means that you are given the opportunity to file a motion to reconsider or reopen, or you can appeal the decision (Form I-290B). The deadline that you will have to meet is 33 days of the decision date. Besides, there is a filing fee of $675.Oct 26, 2021

we filled a i-130 my husband and I live in Lebanon. I am an American citizen he is a Lebanese citizen.

They requested for me to fix I-130a correctly that was what the NOID was. I did that and resubmitted. Then received this message after 60 days.

Like i said i did my own appeal and won but i ended up reappling on top as that was what the immigration court said i could do

and it took longer to appeal than just to reapply and fight the issues in a new petition
