I am sponsoring my kids and spouse, as a us citizen i filed separate application for each family members. i am filing the i864, so do i need a separate i864 for each intending immigrant? I am confused on part 3, do i just check #1 yes or do i need to check number 2 and list the family members. lets say in part 2 i list my spouse as the principle immigrant, do i list my children under family members. or do i just list my spouse as the principle immigrant in part 2 and leave the family member (part 3) blank.

 

my second question is the household size. im currently living in the usa without dependents. so in part 5, under person you are sponsoring in this affidavit (do i include my kids (3) and spouse (1).

No, it would not.  Total Household size would be the same on each I-864.  Total  would include yourself, your spouse, and dependents.  The other members (other than the person being sponsored on each form)  would be shown elsewhere on the form.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Timeline

Assuming you will have legal and physical custody of the kids and they will be under age 18 when they arrive in the US on their immigration visas, you file I-864W for each kid since they will automatically become  citizens.

yes, i have legal and physical custody of the kids. so i file a i864w even if i'm filing for them to get their green cards.

You file I-864W for them. You do not file I-864 for them and you definitely do not pay the green card fee. They don’t need green cards and it is possible uscis will refuse to issue them anyway.  
 

Save your money for their passport, passport card, and certificate of citizenship.

Your entire household will be included in your spous'e I-864......yes.   Follow @Mike E advice for the kids.

i paid the affidative of support fee for my kids at the nvc website. do i still submit the i864w or i864 ? when i applied the i130 i was a green card holder. but now i am a us citizen.

A person becomes a USA citizen provided all of the following  happen before the person  reaches age 18:

 

* the person becomes an LPR

 

* the person’s parent becomes a U.S. citizen 

 

* the person is in the legal   custody of the parent 

 

* the person is in the physical custody of the parent 

 

* the above 4  conditions  overlap by as little as one day

 

Based on your description your kids will become U.S. citizens.  Tragically many if not most parents in your situation are unaware of this.  The kids get unnecessary  green cards and USCIS even gleefully accepts their I-90 renewal fees. But then, after they turn 18 and file N-400, USCIS denies the cases. And by then the trail of data proving the 4 conditions has run cold. You would think parents would take care of their own naturalization certificates but so many toss them in the trash.  
 

I’ve dealt with people in their 30s stranded outside the USA because they have difficulty proving the 4 conditions.  I’m helping another whose parents willfully destroyed all her immigration records and she has  zero documents and cannot even function in the U.S. society.  
 

Lesser tragedies are those who obtain a passport but still the DMV, SSA, and other three letter agencies deny service, benefits, and opportunities including employment 
 

Your actions and decisions now will affect the lives of your children well into their senior years.  
 

Since your status has changed between I-130

and now, you must inform the State department that you are a U.S. citizen.

yes they have been informed that i became a us citizen

each child currently has their own nvc case number and invoice number with the nvc,  the visa category is IR-2 visa

Are they your biological kids?  How old are they now?  If they are your biological kids and they are still under 18 years old, submit an I-864W for each child who is a minor.  If any child is already over 18, you need to submit an I-864 for that child, as they will not automatically gain US citizenship when they enter the US.
