DCF I-130 already filled. option for Uniting for Ukraine program instead?

I already filled a DCF with the embassy in Cyprus for my Ukrainian wife. It has been 5 weeks and still being processed without meaning updates for the Embassy. They cannot give a timeframe. Can I still file for the new program for Ukrainians to get my wife to America? Do I need to request my I-130 petition be cancelled first?

No such requirement and they can not give a timeline for the new programme either.

My guess is that the DCF will come through before the HP filing.

HP may be non immigrant but assume most will stay.

I don't see how there would be any delay, the 2 processes having nothing to do with each other. DCF is for a family reunification immigrant visa which offers many more benefits than the temporary 2 year stay the Humanitarian Parole/Uniting for Ukraine program does.

 

At this point in time we have no idea how fast or slow the Uniting for Ukraine processing is. You could apply for that one while you're waiting to hear back from the Embassy about DCF. If the UFU program is faster, you can cancel the DCF later and she can enter under HP/UFU. Then later she'd have to adjust status in the US in order to get permanent status (green card.)

Thank you for your help!! I think I will do this just incase it will be quicker!!
