Doesn't a K3 need to be work authorize just like a K1? I know it's been awhile since we have seen any of them so I can't remember that detail. If so then the reason for the expedite is kind of pointless as the OP's spouse will not be able to work until AOS is filed and an EAD received.

Hopefully it does just trigger the the I-130 to be pushed forward.

Yes, you are right . I understand that the k3 would be counter productive and you seem to understand the jist of it.

When I submitted my paperwork to Congress it was about the i130, but it was pretty much a retourical response back that that's what they were going to do because the i130 was in active review, so yeah, I really wasn't thinking to  expedite the k3. But I wasn't, "opposed", or going to turn down the ,"nudge" to USCIS (kwim) .

I know its rare , nearly impossible if at all to issue the k3 , but more or less if they call it's an opportunity to state my case and like you say perhaps trigger the i-130.  Thanks for your response.

Well at least they don't charge you for their service. If it was a lawyer he would be fired. Lets hope the nudge works.

In 6 years of reading VJ, I have yet to see a K3 approved.

Also:  You are not unique in having to wait your turn.  We have ALL been there or are there still.  It is part of the deal when a USC/LPR chooses an overseas partner.  Yes, it is a choice, and we are not victims of a cruel government, as many here seem to think.

not sure why you went to your congressman so early

and how he could apply for expedite for u

from what i see an expedite doesn't necessarily mean the case goes very fast thru the process

also beware that since income is a big priority (especially at the Casa embassy) claiming your business may fail could harm the income requirements

wishing the 2 of u the very best TOGETHER

What does waiting your turn mean when it all appears to be random?

I'm seeing people from the same service center still waiting after 10+ months whilst others have been approved in 4 months even though they filed a few months later.

I don't blame anyone for trying to get USCIS to look at their case because it appears as if filing a K3 or putting in a service requests does get a speedier approval (sometimes).
