We were doing the K1 process before but withdrew. Not sure if that is the reason our case got approved so quickly.

 

Our case was originally at the Texas Service Center and was transferred to Nebraska after we submitted the K3.

Timeline

We applied January 16th.

 

I have put in 3 expedite requests over the past 3 months with no answer. After 6 more business days i was told i could request an officer to call me personally.

 

I'm a little disheartened to see people get approved or moved to actively reviewing status so quick ans i haven't gotten a single response to anything.

 

I got more information from my senator so far.

My understanding is the background check is what takes long for the I-130.  Some ppl get lucky on that regard like having an uncommon name.  Try filing a K-3

I'm sorry but that doesn't make sense to me. My cases hasn't been looked at and the expedite hasn't been assigned yet. I don't see where a background check could be holding up anything.

 

I'm a cleared individual so I would find it hard.to believe that a background check would hold me up anyways.

 

Just seems like I'm constantly falling through the cracks here, especially when you request an expedite...3 times.

There’s an interview with a former adjudicator on here somewhere that describes the process.  I read it a while back but it’s pretty old at this point.  That’s where I got that from but who knows why some get lucky and others take forever.  Maybe contact your representative and file a K-3?

What is your reason for expedite?

 

Waiting since January 2022 isn't really all that long... we waited 8.5 months for our NOA2 and there are some filers from April and May 2021 still waiting for their approval. 

 

Approvals seem to be very random. 

Latest  20 approvals out of Potomac (transferred and not transferred) range from 154- 463 days (excluding an expedite case out of Russia that took 72 days).

I've already contacted Ed senator and they reached out. They originally told me that they would be asking for my orders and that the senator could submit it on my behalf or that I could.

 

What would a K-3 help with?

K-3s almost always get denied but some people think they can help speed up adjudication of the I-130.  I did it against my lawyer’s advice and against the advice of some members on here and I got approved in under 2 months.  Did it help? Who knows.  I’ve seen others do the same and it still take forever so no one knows if it really helps.  But it’s free and very easy.

Why did your lawyer advise against it? I'm thinking about doing the same thing but I'm sure my lawyer will be opposed.

Lawyer said they don't issue K-3s anymore and it's a waste of time and money.  People on here said the same.  But it's free unless you pay a lawyer to do it, the form is very similar to the I-130, and it only requires a few documents almost all I already had from the I-130 assembly.  It's super, super easy.

Thanks for the response, I will definitely look into that. I just don't want the law firm to use it as an excuse to drop me as a client.

Hi, I also applied for my spouse in janurary, my case has been in being actively reviewed since the day I applied online, did you do paper or online file?

We applied online but it took about 2 months after applying until we were actively reviewed. Some people get approved a day or week after being actively reviewed, others have to wait months...
