I 751 interview

Hello! 
I got married in September 2016, got the conditional gc in October 2017.

I got separated from my husband in February 2018 (he moved out of the house) almost got divorce but then reconciled in July 2019 (I moved to him to our current address).

USCIS sent me a RFE and responded with few evidence (since we got separated from most of my conditional gc)

Now is case says is Ready to be Scheduled for Interview. Don’t have a date yet.

My husband and I have more new proofs to show for our interview.

My question is, how is the I 751 interview, together or separated? 
Or it could also be stoke interview? 

Id love to hear experiences and advices,

Either is possible. If USICIS suspects marriage fraud the IO will separate you both and conduct a Stokes interview.

You and your spouse should prepare for an Stokes interview just in case they separate you. Since you are together you should be able to prove it if you are both prepared and coordinate your answers to get the dates right.and details of life events correct.

 

Typical Stokes Question the officer may ask:

  • Birth dates
  • How did you meet?
  • Where did you go on your first date?
  • How many bedrooms do you have in your home?
  • Who cleans the house?
  • On what days is the garbage picked up?
  • Who pays the bills?
  • Do you pay bills online or write checks?
  • How many windows do you have in your home?
  • What type of curtains or window coverings are in your living room?
  • Who gets up first?
  • Who sets the alarm clock to get up in the morning?
  • What do you eat for breakfast?
  • Do you have any pets?
  • How many showers, sinks, and toilets are there in your home?
  • What kind of sofa do you have in your living room?
  • Where did you get your furniture?
  • How many televisions do you have in your home?
  • How many cars do you have?
  • How many telephones are in your house?
  • Do you have family cell phone plans?
  • Do you record any television shows?
  • How many computers/laptops do you have?
  • Who is your cable/internet/phone provider?
  • What television shows do you watch?
  • What music do you listen to?
  • What kind of appliances do you have in your kitchen?

Filed for i751 joint application May 2020

Fingerprints reused October 2020, and February 2021 and June 2021 (Yes 3 fingerprint notices)

Case move to National Benefits Center December 2020 for quicker processing from California Service Center

Oct 2021 out of processing time inquiry made, response May 5th 2022 that our i751 case will be addressed at our n400 interview

Combo interview May 16th 2022, in Sacramento

Approved June 08, 2022

 

Filed for Naturalization May 2021

Fingerprints reused May 2021

Those questions are fluff.

 

They are going to want to see evidence of shared address and commingling of finances and other aspects of marriage.  Hopefully you have those things despite the lapse in your relationship.

IOs at USCIS are actually trained to identify marriage fraud in ways that see through that type of rote coaching.

We are married for 5 years now. 
We’ll go together on vacation this month also in March for him to meet my mom.

They will do the stoke interview if you don’t have enough evidence?

Let me put it this way:  evidence of shared household expenses, shared assets, jointly filed taxes etc are much stronger than things that can be coached, such as how yours spouse takes his coffee.

We just submitted our packet in December.  We got the notice that they are reusing the fingerprints from our AOS interview.  Petition is at Nebraska, so hopefully will be approved without another interview (we had one for AOS from K-1).

Not really helpful for ROC. Given that couples have been married for 2+ years when they apply for ROC, they want to see substantial evidence. Especially related to living together (joint leases, deeds, utility bills, etc) and joint financial responsibilities (joint bank account, joint credit cards, etc). They want to see a genuine couple together and -while they might ask you some of those questions -the focus should be on shared life together, not what side of the bed spouse sleeps on.

To deter people from entering a marriage to circumvent immigration laws. That’s why if you’ve been married less than two years at the moment of green card approval, you get a conditional one.

Here is the rationale for this process:  to determine whether the benefit sought (in your case, a 10 year GC) is for the purpose of circumventing immigration law (FRAUD).  

 

A decision (denial/approval) is based on the totality of circumstances; the documentation/evidence covering the two+ year marriage, as well as the interview.  There is no magic formula, it is not black and white.

I'm sorry, I don't want to sound rude, impolite, or fear mongering, but you need to read A LOT about immigration and spend some time here in VJ.

First of all, let me ask you: what is, in your standards, a "good" interview? If by that you mean an interview where you answer all the questions somebody posted above, then no, that's not a "good" interview ESPECIALLY for an i-751. For an i-751 interview, since you've been married for 2+ years, they definitely want to see an intertwined live, such as joint leases/ deeds, bank accounts, health insurance, etc. In fact, some couples have sent such good evidence with their i-751 package that their interview gets waived, or it's merely a formality.
