Have an update on the "Dark NVC" for you ....

Yester day (day 49 post NOA2), I received an inquiry reply saying they didn't have the case and were asking USCIS to locate it (many on facebook have posted the same, just a second version of form letter) ... It did suggest I could call USCIS, so I did.

After much effort, I was able to get to a live person who tacked down the case in their system.  The result?  Case is still at USCIS-California office, has not been released to NVC, no scheduled date when it will actually go out.   So the "Dark NVC" is in many cases, USCIS just delaying cases further (at least for me and a number of people I know on Facebook)

I just entered the NVC waiting phase and I am seeing this too. Seems this is what USCIS is telling everyone, that NVC is telling them to wait about 90 days to send the cases to NVC. People from February/some from start of March seem to be getting their case numbers (as per VJ timelines too), but none after that.

I think USCIS really ramped up their processing but no one thought NVC would not keep up with it...

February 2022 I-129F K1 Case Status Spreadsheet can be found here.
NVC Timelines spreadsheet can be found here.
NOA1:
Feb 22nd, 2022 | NOA2: May 12th, 2023 (444 days) | NVC Received: July 3rd, 2023 (52 days) | Case number: Aug 2nd, 2023 (82 days) | In Transit: Aug 15th, 2023 (95 days)  | Ready: Aug 17th, 2023 | Medical: Sep 22nd, 2023 | Interview: Sep 26th, 2023

I'm suspecting politics more than anything.

Vermont center sent a few cases to NVC and they were processed quick ... other visas other than I129Fs are getting there and processed quick too

My goodness, you are right. I didn't search for other forms, but searched VJ timelines from my country whose I-129f was transferred to Vermont and they take about 6 months to get approved and about a month to receive a case number from NVC. Too bad I have a clean background and haven't been transferred, huh? haha

It has been a couple of weeks since posting an update (Sorry for the delay)
On FB I reported that a crazy number of cases have been returned to USCIS
I don't really have a catagory in this report for that (Maybe I should add it ... it used to be rare)

Burndown report also included ... looks like they are finally doing something about Mid-November 2021 as well

Anyway ... on to the details

Any concerns on the validity period stated on the approved NOA2? I remember seeing 4 months validity for the 129F approval notice. does anyone know what happens to the K1 visa process if the embassy process happens after the date shown on the 129 approval validity date.

I was told today by someone at USCIS that you should wait until the 4 month expiration date passes.  Then, have the Beneficiary contact the embassy or consulate with the receipt number to ask for an extension.  She said not to extend until it expires.  It's a scary thought that something may delay the process or change the approval at that point.  What else can we do though?

USCIS level 1 answer- WRONG!  Consulates, normally, automatically extend if needed.  The petitioner is the one who should request an extension if desired...not the beneficiary.   Why would you wait until after expiration to request an extension?  Doesn't make any sense.

I know.  Calls to USCIS level 1 officers is often called the "misinformation line".
