Does sponsoring spouse have to attend interview?

Hello all,

 

My USC wife and I recently got approved for DCF and we have submitted the I-130 package to the embassy.

My wife would like to go back to the US at this point in time and wait for me to come after I get approved for LPR.

I am wondering if my wife needs to be here in my home country for any further step of the DCF process such as the interview etc?

I agree, and in this case, it may look better that your wife went back to the US to re-establish domicile.

We are in the same boat. We were approved for DCF due to my job offer.  I have to be back in the states in 7 weeks, so my husband will have to stay here on his own to finish the process.  I read in a regulation manual https://fam.state.gov/fam/09FAM/09FAM050402.html the following guidelines.  I think they apply to us. However we are file the petition by mail, so that is different.

(U) Physical Presence:

(i)     (U) The petitioner and the beneficiary are physically present in the district.  The petitioner must file the petition by personally appearing at the consular section with the original documents.

(ii)    (U) The beneficiary is able to remain in the country for the time it normally takes to process the visa.

We’re doing DCF too. What documents do you have to provide after your I-130 gets approved? And how long did it take for you to get approved? Thanks
