Hello,

I am wondering if there is a set period of time Canadians must wait to reenter the U.S after returning to Canada. I came to the U.S with a tourist Visa for my cousins wedding, I have gotten married myself soon after to an American Citizen. We have applied for an i130 visa, but I do not want to overstay my 6 month tourist stay. If I leave for Canada for 2 weeks, would there be any issues coming back into the US? I work and have an address in Canada.

There are people who visit weekly but sounds like you have been in the US 6 months?

How long do you think you will staying when you come back to the US? Remember, the amount of time you can stay in the US is determined at the border, so it is possible you will get a much shorter time that you can stay in the US the 2nd time or even be denied entry. Also, remember that provincial benefits are based on residency and staying out of the province for an extended period of time could affect your residency status.

I’m a Canadian Citizen, and I was hoping that by reentering the US by staying in Canada for 2 weeks I could stay for another 6 months within US

Someone on another thread, also Canadian, wrote that after a 6 month stay she got 3 months on her return after a short trip out and was asked to show her return ticket. Being Canadian doesn’t allow you to abuse the tourist status system - the principle of not using B status to effectively live in the US applies to everyone.

 

You may want to look into the tax implications of spending more than 183 days a year in the US.

It doesn't work that way.  It doesn't "reset."

 

If it appears that you are abusing your tourist visa by using it to live in the US, you will have problems at the border.
