Hello, thank you for all your help in this forum. 

 

I have a question about the required documents from Petitioner and Joint sponsor. From what I understand both need to provide same things:

 

  • I864
  • Proof of income (and assets, if any)
  • Proof of U.S. citizenship 
  • If relevant, Form I-864A completed by each individual who will combine their income and/or assets with the joint sponsor’s to meet the minimum annual income requirements.

 

However to prove income what combination is required? Letter from employer, W2, recent tax year or all 3 yeas, or 6 months pay stubs? What if the Joint sponsor was in military and his W2 is low for last year.

Recent tax year (2020) & IRS Transcript is the most important. If his recent IRS Transcript does not reflect enough income, then he will need his W-2 and Paystubs.

If he was in Military, I believe it is 100% of poverty line as compared to 125% for non-military.

copy of 1040 needs W2's ,  any 1099 or 1099 R to verify the 1040 

And that is about the past.  A current pay stub or leave and earnings statement from the military is the evidence needed to support the stated current income.

 

Joint sponsor needs evidence of current US residence.  A copy of a driver license or utility bill will do.

No, the tax transcript is not most important.  It is required though.  MOST IMPORTANT is the evidence of current income, like a pay stub.

 

No on the military statement too.  The 100% for military applies only to the petitioner, not a joint sponsor.

Oooo I thought OP was talking about sponsor. And yes, the poverty table clear says "sponsor."
