CR1 VISA PROOF OF MARRIAGE

Do you have to live together to do the CR1? I have no way to live with my spouse in his country and he cannot come to the US to live until after he gets approved. How would we provide proof of marriage other than a marriage certificate if we cannot live together until he can legally come to the US? Bank statements just doesn't seem like enough. What else can we do provide proof??

No. Indeed with DCF pretty much extinct, it is difficult to impossible for the petitioner to have required US domicile and live with the beneficiary. Besides which the petitioner is expected to have US sources of income and generally can’t very well do that if living outside the USA.

You show proof of frequent and recent meetings, video call logs, text message logs, emails, commingled finances, etc.  

 

The minimum legal requirement is one physical meeting between the married couple before filing I-130.

So many couples struggle to get even that much.  The red tape to do that is hard so well done.   
 

Are you filing joint IRS tax returns? Are you listed as beneficiaries on each other’s life insurance polices? Anyway to add each other to rental leases? Any way to add names to titles of property?

You will have passport stamps showing you were in his country, photos together and with family, examples of how and how frequently you have been communicating, and receipts.  You can print examples of how and how frequently you communicate.  Note that words mean things.  You are not asked for "proof of marriage" beyond the marriage certificate.  What you a talking about is "evidence of bona fide marriage RELATIONSHIP"
