Hello everyone! As we all know USCIS has been backed logged and seems and feel like taking forever for most of petitions to move or get approved. My mom has filed for my dad to come here. PD is 10/2019. I realized that California Service Center is one of the slowest and that is where my mom’s petition went to. My mom is a GC holder. Anyway, the question is.. That petition  for my dad, my sister is also a derivative. She is now 19 y/o and it is making us nervous about how she is getting close to turning to 21 y/o and afraid and have the question of “what if” she don’t get to come here before she turns 21. Also, I have told her to not go to school yet for college back home because she probably will move here before she finishes. Told her that last year but they still not here yet and telling her the same thing hoping they get to come in the next year. Please advice!

Just hope that F2A stays current till the case gets to NVC. The i130 processing time can be deducted from her age at that time even if she turns 21.

The longer they take to approve the more she is protected by CSPA. She already has more than 1.5 years protection so at least until she is 22.5 she will be ok. If CSC processing times don’t change much the petition will probably be approved in the next few months. https://egov.uscis.gov/processing-times/ If F2A remains current, then the approval date will be the date that a visa number is available and her CSPA age will lock in as of that date. So I personally don’t really see any big concern that she will age out. (As to when they actually get visas well, that also depends on the backlog at the embassy.)
