Hi, my father is a LPR and he filed up a I-130 form for me at 09/25/2020 (I was 20 years and 10 months old). So i was at the F2A category. My priority date is october 1st 2020. At the 18th of october 2021 i became 21 and i was wondering do i still considered to be in the F2A category or did i fall into F2B as the adult child of an LPR?? Because my  file is at Nebraska service location and F2A processing time has passed my priority date. When i tried to send uscis a unquiry for outside normal processing time and results said “my application is currently within the posted processing times”. I don’t understand does CSPA work for me or should i do something?

At present you are covered under CSPA, and will be so as long as F2A remains “current”. You may need to recalculate if they shift to priority dates to determine visa availability before you interview.

 

Your file may have moved processing centers, sometimes they move them around to spread the workload. Most of them take longer to process F2A.

Here is how CSPA will work for you.

 

If the F2a category is current when your I-130 is approved, then you will not age out.  Your Priority Date will be current and with an approved I-130, your CSPA age will be locked in at 20 years and 10 months.

If the F2a category is not current when your I-130 is approved and it takes more than 2 months for your Priority Date to become current, then you will age out.  Two months for a current PD plus being 20 years and 10 months means that your CSPA age will be over 21.  You will age out into the F2b category.

There is no way to know right now if you will age out or not because there is no way to know if the F2a category will be current or not when your I-130 is approved.  Trump's ban and COVID has created a huge backlog in the F2a category.  This could mean that we will not see the F2a category remain "Current" in the future.
