Ok so, if you are still married you are still F3 regardless whether or not he goes with you. F3 depends on your legal marital status, not whether or not your spouse immigrates with you. If you get divorced, you can change category to F1.

You are properly in the F3 category because you are married.  You do not need to inform the NVC since nothing has changed.

 

Did your husband file a DS-260?   

Just to be sure, it's your USC parent that filed for you correct?

yes, I am filling form DTS 260 for my husband and my children.
 

My mom is petitioner.

You do not need to inform the NVC that your husband does not want to immigrate.

 

At the visa interview, you can tell the CO that your husband does not wish to immigrate to the US.

 

Since your husband is not immigrating to the US, you will need his written permission to allow his children under age 18 to immigrate to the US.

 

Does your husband understand that if he does not immigrate with you that it he changes his mind, it could take up to 2 years for you to petition an immigrant visa for him?

DS260 is only required for family members who will be immigrating with you, so do not submit one for your husband. In the section in your own DS260 where they ask for spouse info, when they ask “is this family member immigrating with you” you check no.

 

As noted above if the children are under 18 you will usually need permission of the other parent for them to migrate with you.

I did filling DS 260 for my husband and my chick  “yes” at that time and now he doesn’t want to immigrate and children also stay with my husband. 

 
That’s mean I will returning to my home country when I obtained green card because I just wish to visit my mom often and taking care her when she get old. 
 
I also don’t want to stay in USA. 
 
Do I need to inform embassy when I get interview or I should inform NVC in advance. 
 
Anyway, I did filling all DS 260 for myself and al my family member and NVC was said those documents qualified and in line for interviews.

A green card holder is required to make the US their home.  A green card is for you to come live in America.  You can not use a green card as a tourist visa.  

The US Embassy could deny you an immigration visa since you have no intention of living in the US.  

If you get an immigrant visa, you will eventually lose your green card for not living in the US.

You don't need to.  You can tell the US Embassy at your visa interview that your family will not be immigrating.  

It's going to look very strange to the CO that you want to immigrate to live in the US alone without your husband and children.  They may not believe you intend to live in the US as required and may deny you an immigrant visa.

Well then you can tell the CO at the interview that they’re not coming after all,  but it’s pointless you going through the process yourself if you don’t want to stay in the US. You need a tourist visa, not a green card.
