Hello,

 

im hoping someone could advise on what I can do... 

I recently filed for a k-1 for my fiancé in December 2020, case is still pending... along with that a waiver that was also filed due to past petition that was denied.

As of today we are now married and I want to file a I-30, I spoke with an agent online and they said I can file but need to notify the location of where my waiver is being processed (Nebraska) and also withdraw my I-129f petition so it doesn’t cause too much confusion.

I get all of that instruction, so where i’m hung on is if I should file online or mail in the application, I have no problem doing either but of course the online option seems to be easier. 
I read somewhere on the USCIS website that If you need a waiver do not file online, mail it in, but I wonder could there be an exception because I already have a pending waiver, it’s not like I’m just starting a whole new case.

 

Any advice would be most appreciated :)

July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

Your I-129f is now void.  You can email USCIS and inform them that you want to withdraw the petition.  Why do you need a waiver for the I-130?

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Because in 2018 we applied for a K1 and was placed in Admin processing. He was eventually denied and given a life time ban, only way to reapply for any visa is to apply for a waiver, so we applied for the waiver when I initially did another k1.

do you think I can do the I-130 online or should I mail it in, the waiver is still being processed

That is filed after the interview, the CO has to make a determination that there is a bar and a waiver is available.

DO NOT TAKE LEGAL ADVICE FROM "AN AGENT ONLINE."  If you are talking about the USCIS information line, you should be aware they are contractors and are not allowed to give legal advice.  If they give you the wrong advice and you follow it, then it's your problem, not theirs.

We have a waivers specific forum here.  I still recommending filing the I-130 online.  There are glitches in the online filing system.  Don't expect any part of this to be easier.  Easier does not mean better.

Facts are cheap...knowing how to use them is precious...
