CR1 visa doubts

Hello all, I am from India and my girlfriend is from Florida, USA. 
we been together from 2 years. We are planning to marry in July 2020 But due to lockdown in India, my girlfriend wasn’t able to get Indian Visa.

Finally today she got the Indian emergency visa for marriage. We will be getting marry in the month of August 2021. 
 

After that we will be applying for spouse visa CR1. I have questions to ask, I hope you guys can help me in this.

 

she want to stay with me in India for the whole CR1 process. She won’t have an income then, as she cannot work in India as per the law.

can she just show her bank account as a sponsor or income is necessary? If income is necessary than she cannot sponsor me.

can her friend sponsor me in this case?

The spousal visa process can take 12-24 months.  

She can use assets for the I-864.  At least 3x the 125% poverty level for her household.  For a household of 2, it would be about $60,000 in assets.  Cash or brokerage accounts are best.

If her friend is a USC or LPR, she can be a Joint Sponsor if your wife can't meet the I-864 financial requirements.

Thank you for the response aaron, she also have 10 year old son from her last marriage but the son will be living in USA with my girlfriends mother. So in total, my girlfriend  has to show $80000 now?

Can my father be a sponser for me?

Her son is included in her household.  So at least 3x the 125% poverty level for a household of 3. 

Be aware that money that suddenly appears in her accounts will be scrutinized.  Too often people use loans and falsely claim that it's their money.  

Your assets can be used for the I-864 in addition to her assets.  

A Joint Sponsor has to be a US citizen or LPR.  Is your father a USC or LPR?

My father is none of them, so he cannot.

No.  Her friend as the Joint Sponsor would need income and assets enough for her household plus you.  The amount will depend on whether she's using income or assets.

Now we want to marry this year. Please explain me the procedure of emergency visa brother.

Your fiancee needs to contact her nearest embassy. Is she from USA?

Yes she is from USA and we are stuck from more than one year.

"Emergency visa"?  Because of Covid?  Won't happen.

There are no US embassies in the United States.

Based on the original post, they're talking about getting an emergency visa to India from the Embassy of India in the US.
