I was single in my first application which was a visiting visa  and engaged when I filled the second and that was even a student visa. Been trying to see where I could have gone wrong but I just can't find any

Did you put the person who you were engaged to as your spouse?

Yes I did.  he is my husband today

But he was not your husband at the time you filled out the prior visa. Being engaged is NOT the same as a spouse

No I ddn't get your question .. there was no where I included his name where I wrote engaged on my previous application because there was no where it was asked on the form. His name appear only in this recent application

There must be something serious that is different between the applications, or something you failed to mention.

Regardless a willful misrep carries a lifetime bar so you will need a very good lawyer to get a waiver

I'm just going through mine head because I applied twice already and  It was then mine fiance. Which I highlighted that I was going to visit. But now I am married. So they are still with all your documents now ?

They are only with my husband's divorce certificate

Was your husband divorce certificate the original one or the photocopy of it ?

Was a true certified copy. He mistakenly submitted the original to uscis

That is very distressing because misrepresentation is a big deal. It will be difficult for anyone here to tell you what it was because it could be any of several things however normally you should be able to tell either because the interviewer stressed on a particular question etc. Also because you didn’t previously use an agent, you should know exactly what information you have previously provided them which has been contradictory or false.

in 2003 when I applied for a UK visa (for the second time) I was asked about the person I claimed I was visiting on my previous application five years prior. I was ready for the question and told them the name and that he was a close family friend, a colleague of my father. The interviewer then asked how come five years ago I called him my uncle. I replied that in our culture every older close friend of the family is an uncle. He accepted the explanation and let that slide and issued me the visa, it could easily be refused on the basis of misrepresentation. Whew!

I hope you get this resolved. A good immigration attorney with experience in misrepresentation is suggested, I don’t know if you can get one in the USA to represent you, that would be my preference if possible.

Just another random guy from the internet with an opinion, although usually backed by data!

Time for an attorney with experience in waivers.  This is a lifetime bar from entering the US....for any reason.
