My IR 1 visa interview is scheduled this Friday, I already did my medical. If all things go smooth my to-be-granted visa will expire at the beginning of May next year.

My husband and our 3 kids are all US citizens, they don’t have a “deadline” to check into the US soil like me. I want to wait for them to finish school year (mid of June) and contract (mid August) before we all move to the US together as a family. But it will be approximately 3 months after my visa due date.

My question is, what should I do? I thought about delaying my interview appointment but with covid I don’t want to risk the embassy closing its doors again. Do you think the officer can extend my visa due date? Or should I ask for reissue of visa? I don’t really want to submit the documents again tho.

Do I have to arrive in US with my husband (the petitioner)? In that case we really can’t go before May given he is still in contract and he can’t take multiple weeks off for flying back and forth plus quarantine.

Any input is very much appreciated!!

As u mentioned canceling the interview might not be the best option. If u can afford it, once u get the visa travel to the US even if is for 2 weeks or so that way, USCIS will start printing /processing your Green card.

Secondly once u admitted at POE they do stamp you passport for a Temp Green card, some said is valid for 1yr on multiple entries (i stand to be corrected on that).

The petitioner must enter the US before or at the same time as you.

Your visa will not be extended.  Reissuing a visa is never a sure thing.

The best thing to do is reschedule your interview.  The expiration date of your visa will be 6 months from your medical, so you would have to do that again.

If you don't mind, please keep us updated on how you navigate this.  Sounds like you need to reschedule your interview and hopefully you can go to the back of the line.  As someone said, you probably will need a new medical.  Small sacrifice if you can achieve your goal.  It sounds like ideally you would all fly together in August / September.  That means your new medical will need to be after your current expiration, to give you a better 6 month window.

I am in a similar situation, but just starting.  I am just filing petitions for my wife and step-daughter, and we have two U.S. citizen daughters too.  I am trying to time our move for June 2022, after they finish their school year.  So hopefully, I can target the medicals for March / April 2022.

Dear all, I managed to talk to the officer in person today at the embassy, she understands my situation and allows me to reschedule my interview at the later date. Since I already did my medical, I will have to wait until the current one expires (6 months) before I can do another one. She said if I sat for the interview today, my visa will be approved unless they could find a reason not to, and I’ll have to leave in 6 months. Visas cannot be extended for any reason. So I’m grateful I am given this option to reschedule my appointment, that way my family can all move together. Fingers crossed it will all go smooth as planned at the end. Thank you so much for your help!

Thanks for giving us an update. I think alot of us are in the same situation. For me the I130 process went WAY faster then I thoguth at only around 100 days. Right now I am delaying at the NVC stage as we dont plan to move any sooner then the half point of next year.
