Hi, 

 

I am petitioned as an F2b visa. My mother is already a citizen but currently she is not in the US any more due to some medical reason she should not travel alone anymore. 

 

What is my best option for this?

 

And I got  a letter from NVC today saying this? 😔

Your mother as the petitioner must live in the US and have a US domicile in order for you to be eligible for an immigrant visa.  Without a US domicile, you are not eligible for an immigration visa.  

Best and only solution is for your mother to move back to the US and establish a US domicile.

Proof of domicile means how the petitioner (your mother) proves that she lives in the US. Which means proof of residence, bills, job, etc. If your mother is does not have domicile in the US, you may not be able to immigrate. The family category of immigration was made for family reunification. How are you going to be reunited with your mother if she is not here?

Mom needs to live in the US. The visa is for family reunification..if she’s not in the US there is no reunification happening.

There is only one option, she needs to move back. It is possible but not usually easy to show intent to move back to the US, but the only real way to show it is to actually move back - have a permanent home and all the day to day evidence that goes with that (utility bills, voting records, bank accounts in use, job etc).
