I think the only problem is when they add to more than 6 months in less than 1 year.

Hey guys! Just filed under the 3 year rule. Newark filed office. I have a quick question so right now im 32 years old and the selective service question came up, I tried to check to see if I was registered  but nothing came I guess I never registered. I did upload a letter explaining that I was not aware and that if I knew I would have register, I also noted that I will be bringing my status information letter the day of the interview... do you guys think that should be ok?

AOS FROM B1/B2 

2/13/17    Packet sent in the mail to Chicago Lockbox via USPS through my lawyer.:D

2/14/17    Packet received 

2/21/17    Both Checks cashed

02/25/17 Received I-485 and I-765 in the mail.

The question asks if you were a resident between your 18 and 26th birthdays and registered for selective service, so that's the first thing you should need to know. Read the question carefully.

Also, be careful telling them that you were not aware, since they state it clearly on the form I-485, and some IOs don't like those excuses :)

 

If you needed to register and didn't do it, I'd suggest better check with your lawyer just in case

Yes , my case is more than 6 months within a year BUT each trip less than 6 month. Hypothetically, IO asked me about this. What should I prepare ? thanks

 so this is what my lawyer said;

 

Applicants Over 31 Years of Age

Failure to register for Selective Service will generally not prevent a man who was over 31 years of age from demonstrating that he is eligible for naturalization. This is because the applicant’s failure to register would be outside of the statutory five-year period during which the applicant must show that he is of good moral character and disposed to the good order and happiness of the United States. (Note: The applicant must be at least 31 years of age on the day Form N-400 is mailed to USCIS to create the five years of permanent residence since turning 26.)

 

I'm getting a status information letter from Selective services and bringing it to the appointment my lawyer says they most likely won't even bother asking since I'm 32 years old.

From the USCIS website:

 

“Continuous residence” means that the applicant has maintained residence within the United States for the required period of time shown above.

Extended absences outside of the U.S. may disrupt an applicant’s continuous residence.

 

Applicants are required to show that they were:

  • Physically present in the U.S. for thirty months within the five year period before applying, or (see legal basis)
  • Physically present in the U.S. for eighteen months within the three year period before applying in the case of qualified spouses of U.S. citizens (see legal basis)

In addition, applicants are required to show they have resided for at least three months immediately preceding the filing of Form N-400 in the USCIS district or state where the applicant claims to have residency (See 8 CFR §316.2(a)(5) & §319.1(a)(5)).

 

 

This is what you need to make sure you are compliant with. If you are not, the best thing will be to check with a lawyer.

Can we file on the 90 day mark or is it a bad idea? My green card 3 year anniversary is January 25 2021. According to the calculator I am now elegible
