Travel Risk with AP Card

Hello,

 

I have a combination EAD / AP card that expires in March of 2021. I plan to travel outside of the US within the next couple of months, however, I would like to see if anyone has any experience or has heard stories regarding this type of situation.

 

What is the risk that I will not be allowed re-entry into the United States?

 

For additional reference, I am a Syrian citizen who entered the US on a K-1 Fiancee Visa in November of 2019 and have not been scheduled for my Adjustment of Status interview yet. I am currently waiting for them to schedule it but still nothing yet.

 

I am a bit nervous that there is a chance I won't be allowed entry back into the US even though I have the AP card.

 

Does anyone have any experience with this? Do you know anyone who had the AP card and wasn't allowed entry back to the US?

 

Any insight on this would be greatly appreciated.

If you have a valid Advance Parole document when returning, you are very likely to have no issues.  After all, that is the purpose of an advance parole document.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I live on the US-Canada border and have travelled back to my home country (Canada) many times on AP with no issue. Can’t tell you what kinds of delays there are now with covid, but unless you commit a crime during your travels you will not have an issue reentering using AP.

You have the same chances of being let in with a greencard as you do with an AP. The whole point of AP is ability to travel. Too many people freak out about this and I don’t understand. Are you planning on traveling to Syria? If so then expect scrunity regardless if you had AP or a greencard.

My husband (USC) and I are also thinking of traveling back to Germany in June 2021 once I have my AP document. I just received my EAD card yesterday and it came with a paper stating that they could always deny someone at the airport even with the AP document, which kind of scares me. I also thought then why would we file the I-131 if there is a chance of getting denied?

Because only US citizens are ever guaranteed entry.  But that shouldn't stop you from using the AP for the purpose it was issued.
